Do I need an authorization from a seller to sell my product under his listing?
Hello everyone, I would like to know if when I am trying to add a new product on amazon, but that product is already there, to match that product with an existing listing on amazon do i need to have authorization from the seller if I decided to sell my product under his listing? We are selling the same product but different brands, so for example, we both are selling case protectors for iphone 15 pro max, but he got his very small brand logo on his cases and I have my brand logo on my cases, it is not an issue if match my product under his listing? I can see i have access to list my product under his listing, so i dont need to apply for an approval, but I am not sure if I need an authorization from the seller to sell my product. If i match my product under his listing, can he report me with amazon? Hope someone can share any experience with me or any answer, thank you!

An Amazon detail page is brand specific, except for those pages created for generic (no brand). You may not list a different brand than what the detail page specifies.
Thus you see the exact same Alibaba item shown on a dozen different branded detail pages.

No, that is not allowed. Imagine YOU create a product with your brand, invest time and money, create a listing on Amazon and two months later you see another seller with HIS brand selling on your listing? Would YOU like that? No, that is forbidden and will make your account suspended.
If you want to sell YOUR product you have to create YOUR listing.

So no, you cannot sell under the ASIN of a different product, even if the only difference is the brand. You cannot list Dole bananas on the Chiquita listing, Nor your branded phone cases on his (differently) branded phone cases.

Only way to sell someone else's branded products on Amazon.
1. Get authorization to sell on that category from Amazon
2. Get permission from the brand owner to be able to sell that product on Amazon.
3. Sell under the same listing, you cannot make a brand new listing (ASIN) if the product has an identical existing listing. You will get a different FNSKU to match the product to your account. Otherwise, if you comingle products, it will be complicating to track your specific products and quality.
If you do not have permission to sell other people's brand, just don't do it. You will get account suspension. That's brand hijacking. Start your own brand, put the work into building your own listing.

Those are two different items, regardless if you sourced it from the same Alibaba manufacturer. If you listed branded item on another listing, you'd leave yourself open for account deactivation for counterfeit/trademark infringement.
If your branded item is trademarked, you need to get brand registered, get your own GS1 UPC code, and create your own listing from scratch.

Not technically true, you do not need to be Brand Registered with Amazon or even have a USTPO trademark registered to have a BRAND or TRADEMARK. If you have sold your products under your BRAND name across state lines then you can claim you have a trademark. You can buy a single perpetual GS1 UPC for $30 and attach your Trademark and business to that UPC in the GS1 Database and create your own Product Detail Page on Amazon. I highly recommend having your own Brand Web site where you will have your Own Images and write your own product details hosted so when Amazon claims that you as a seller don't won the brand (because you are not brand registered) you can point them to the Brand web site to see the Product Details supporting you in what should be on the Product Detail Page. You should also copyright your images instead of simply using the Alibaba manufacturer images that everyone else is using. If others scrape and copy your listing, you have to go after them for copyright infringement.
BUT, as others have pointed out, it is probably better to find a niche that doesn't already have hundreds of thousands of listings for almost identical products.

No, you do not need the other seller's permission, as that is not allowed under any circumstances - permission or not. Strongly recommend that you read at least the basic policies BEFORE you start doing anything on Amazon - otherwise you will end up with a permanent suspension and ban.

I hope this is not the case with you, but I have read many posts by sellers complaining of trademark, patent, and intellectual property violations from other sellers. But if one looks in temiu or alibarbar you find more than a dozen people, including them, selling the same thing.
