Price Matching to an Off-Amazon Seller that is selling expired product

For the past month, we have been losing the buy box or eligible featured offer on one of my ASINs due to Amazon's off-site price matching bot or algorithm.

I have reached out to seller support multiple times but they give the same usual answer, we are not eligible to be a featured offer because my price is not matched competitively to other retailers outside of Amazon.

The thing is, we as a company monitor all of our inventory sold in to retailers/distributors as well as Amazon. There was only one instance last year where we sold this particular ASIN to a retailer/distributor and it had an expiration date of 2/28/2024. It has been over a month since that lot code has expired. If I had that lot code in FBA right now, I would have been hit with a disposal fee already but no, Amazon is choosing to honor the off-site seller that is listing our ASIN for 40% less (because it is expired and they are probably trying to recuperate some money back) and I am stuck with the answer of needing to match the lowest competitive price.

As sellers, we have to go through strict requirements to send in product, pay fees to list an item, pay fees for storage and fulfillment but off-site sellers do not. Amazon's policy needs to be updated to take into consideration key facts that could be driving off-site sellers to list an ASIN at a lower price.

At the end of the day, if we don't make money, then Amazon doesn't.
