Classic Received an empty parcel, £800 refund!

Hello Everyone,

Recently sold a PS5 pro, was sent special delivery, with signature, GPS location, photo, and weight confirmation. Customer claimed empty parcel, even though the images showed no seals broken, and got refunded by Amazon through A-Z Claim (bought shipping label from Amazon, no extra protection, what so ever).

Of course, challenged the claim, and awaiting an outcome, but wanted to ask, claiming through royal mail, what would be the best way to go about it?

Cheers

I believe for Special Delivery the compensation is up to £750.

However, the issue you are likely to find is claiming via Royal Mail for a label bought by Amazon...the details are below but I can almost guarantee Royal Mail will state to you that Amazon need to claim.

File a claim with Royal Mail

I have had success claiming for Special Delivery Labels sent through Amazon. This has been for non delivery (no scan) and late delivery.

In your case RM shows delivery so I doubt they will pay out a claim unless you can prove it was sent to the wrong address or something similar.

You may want to think about taking legal action against Amazon to recover the money. You can take it against the customer but beware that Amazon T&C's prohibit this so a safer bet is Amazon who often pay out when faced with legal action for claims such as this.

From the details you give you have no claim against Royal Mail. The customer admits a delivery was made as they claim empty box and you state the seals were intact (presumeably visible in the delivery photo), so on what possible grounds could you claim against Royal Mail?

Any case could only be against Amazon as they're the ones who paid the refund despite there being full evidence of a signed for delivery. Appeal the A to Z first and if no joy riase to the MD email and if still no joy consider a small claims against Amazon.

I still have no idea what extra protection is offered by buying shipping labels through Amazon when any tracked service shows when the label is bought, when the item is collected/dropped off and when it is delivered. Whatever voodoo extra protection there might be is a mystery to me.

But surely if you have weight confirmation and the seal was unbroken, that should be enough.

To be honest, I believe that Amazon should give something official to fill and sign in these cases, that might deter some people. They used to do it in the good old day, I ordered a book that never arrived over 20 years ago and had to declare that I never received it. As a honest customer I didn't mind having to declare that I never received the book, it's not customer centric to give freebies like this, it's just lazy.

You could send a form to the buyer,by signed for delivery. to sign & date, with a SAE to return, stating the fact that they received an empty box as you need this to file a police report & claim compensation from Royal Mail.

I would actually physically go and get the Pro back from them, if they've done it to you they have done it to others repeatedly. Take all your evidence with you and if they refuse to hand over call the police on the spot, see how they like that. Amazon are actively allowing this to sellers and the carrier companies wont give you any compensation at all, as its been stolen.

Hopefully you took the serial number down.

If you bought the console through the official distribution for the UK, you can ask them to request Activation data from sony - they can tell when it's switched on the first time, and roughly where.

@Seller_jrQPSkCeMxq1YWhen I saw this few days ago, I immediately thought that the person just got free PS5. However, my partner ordered something quite expensive from Amazon as well which arrived today. Even though the seal wasn't broken, the Amazon box contained the box of the item which was empty! I have no idea how it's possible but maybe some Amazon employees or delivery guys found a way to empty higher value packages. Now I do think the person truly received an empty box and the fraud was done elsewhere.
