Intellectual property complaint
Hi guys, just received an email about one item i have listed 2 weeks ago. I have read many of posts here on this forum but im still lost. Im new here as a seller and rly dont know how to react on this message.
Seller is complaining that they got branded product listed and i did list it under their brand what is not correct when on pictures is exact same product i have posted. There is no their brand appear on the product and we probably bought same product from same wholesale. So for me seems stupid to report and say that product is under their brand. Our products got exact same barcode (ean) and exact same packaging. So i dont know what to do. Im not rly happy to “appologize for the misstake” because i did not make any misstake when i listed product under same asin.
Could anyone help me out please? I did remove listing already, now i have to respond to this email.
Hello,
We removed some of your listings because we received a report from a rights owner that they may infringe the rights owner’s trademark. The rights owner communication about the alleged infringement and the listings we removed are at the bottom of this message.
Why did this happen?
We received a report from a rights owner that one or more of your listings are inauthentic. Listing content infringing on the intellectual property of others is against our policies.
We’re here to help.
If you need help understanding why your listings may infringe the intellectual property rights of others, please search for “Intellectual Property Policy” in Seller Central Help.
How do I reactivate my listing?
Go to Received Intellectual Property Complaints under the Product Policy Compliance section in account health and locate the deactivation record for this product listing. Click on the Appeal button next to the listing deactivation record to submit information necessary to reactivate your listing.
Have your listings been removed in error?
If you have never sold or listed the product, please reach out to us and tell us.
If you think that the rights owner has made an error in sending the notice, please reach out to the rights owner and ask for a retraction of the notice. To retract the complaint, the rights owner must send the retraction to us at notice-retraction@amazon.co.uk or use the retraction function in Brand Registry.
These are the rights owner’s contact details:
Bhavin Patel
We can only accept retractions if the rights owner clearly states that they made an error. For any other reason, please explain to us why you were warned in error so that we can investigate the case.

The listing is branded by them and they also own the EAN on the listing. If you had listed by the EAN on the product you would likely have found the correct ASIN.
That’s not to say the listing is 100% legit.

Hello @JDolinaj,
I’m Kavi from Amazon, here to assist you.
Thank you for writing to the Seller Forums Community, and we appreciate the efforts from @Demel and @Sequin.
We understand your concern regarding Intellectual property complaints.
Amazon is dedicated to ensuring that products on its marketplaces do not violate or infringe a Rights Owner’s intellectual property (IP) rights. Rights Owners can report infringing content they find on Amazon and share answers to frequently asked questions on how Amazon handles infringement complaints. A Rights Owner includes any person (such as a brand, a seller, a customer or any third party) who legitimately owns intellectual property rights for the product in question.
To learn more about intellectual property rights, please visit your local intellectual property office.
If you have an established relationship with the rights owner who submitted the complaint (license, manufacturing or distribution agreement, etc.), we encourage you to reach out to the rights owner and request that the complaint be retracted. If Amazon receives a retraction from the rights owner, your content may be reinstated. The rights owner’s contact information is provided in the notification you received.
If you consider it to be a probable listing error from your end, we recommend you to kindly get to the root cause of the issue in hand. Once, you confirm the details from your end, we request you to please click on the Appeal button next to the listing deactivation record and submit the information necessary to reactivate your listing.
For more information about the Amazon Intellectual Property policy kindly refer to the Intellectual property for Rights Owner policy.
If you have further questions, please keep us posted, the forums community and I, are here to assist you with your concerns.
Regards,
Kavi
