Amazon damaged my FBA items and charge us disposal Fee when this unjustice will END?

Has Anyone Experienced This with Amazon FBA?

We sent inventory to Amazon FBA, and they successfully received everything without reporting any damage. We sold over 600 units without any issues. Then, a random person (not the brand owner) bought a Brand Registry for the product and falsely reported an Intellectual Property (IP) violation.

Amazon removed our listing and requested invoices, which we provided. As many sellers know, Amazon’s verification process is often inadequate, and they failed to verify our legitimate invoices.

That was bad enough, but here’s where it gets worse:

Amazon has been slowly returning our inventory for almost six months, and they still haven’t finished.

Recently, they disposed of 63 units, claiming they were damaged while in their warehouse.

They charged us disposal fees even though it was their fault!

When did Amazon stop following its own policies? Their FBA terms clearly state that they are responsible for lost or damaged inventory, yet they are ignoring their own rules while expecting sellers to comply with theirs.

I have decided to take legal action against them for this. Someone needs to hold them accountable. Has anyone else experienced something similar?

Amazon’s FBA Responsibility:

According to Amazon’s Terms of Service, under FBA Inventory Reimbursement Policy, Amazon assumes responsibility for inventory once received at the fulfilment centre. If items are lost or damaged due to Amazon’s fault, the seller is entitled to reimbursement. In this case, Amazon’s actions have directly led to financial loss, and we are entitled to compensation.

As far as i can recall without looking at the policy, Amazon will reimburse for the damage but sellers still have to pay for disposal.

I do believe though that there are exceptions which you will know whether apply here or not from their policy.

I had a similar issue where I was buying directly from the manufacturer, knowing full well I sold on amazon, they then decided to sell themselves and issued false IP claims. They briefly withdrew them but not enough time to sell through much stock. Amazon never accepted any invoices from the manufactuer and complianant and destroyed several thousand pounds of my stock at my expense, and several other people in the same boat. I considered taking legal action but was worried it might be my account at risk to do so.

It is the same with my items. The buyer frequently returns them with a message saying something like 'inadequate packaging so item damaged'.

Amazon then mark it as customer damaged and make me responsible for removing the now damaged item.

Once bitten twice shy FBM all the way tried it lost items charged for Amazon mistakes post it yourself and hold all the stock, no mistakes then, no disposal fees and no charges you don't understand.

Amazon removed our listing. Nowadays, this kind of malicious registration happens often, we should register trademarks as soon as possible. Saaad.....
