Fraudulent parallel Imports Claim
Hi, I’m a UK seller who has recently started my FBA journey. All has been going exceptionally well for my first month until one of my better-selling products was blocked for intellectual property rights violation (parallel imports). This happened about 36 hours ago and has put my account health at “at-risk”. My first question is how long do I have to deal with this claim before my account could be suspended?
Now, this claim is fraudulent because the filers of the claim are the other seller on the listing and have falsely branded the product with their seller name. As per Amazon’s brand identification page the product is clearly branded and they have branded the listing differently. However, they are 100% not the property rights owners of the product. The company in question has a generic outlook email and simply stated in their communications:
“We are the brand owners of the listings, we have not authorised, anyone to sell our products. Please check and reinstate.”
I understand I can follow the standard appeals process to reactivate my listing, however, I am aware I have to provide a plan of action and I’m not sure what that would be. I have sourced these products from a legitimate wholesaler within the UK and have invoices to prove this.
Does anyone have any suggestions on how I handle this? or how I can counter this to stop the other seller from being so hostile.
Any help would be greatly appreciated!

I understand what you mean i have come across this lots on amazon, its one of them frustrating things about selling on amazon people just branding a well known product as there own and amazon doing nothing, If you don’t have a lot of stock I would just move on as amazon wont do anything to help you and if you did get it reinstated they could and most prob would try kick you off again
There is so many listings like this on amazon and has been for ages, hope all works out for you

When you listed the item did you list using the barcode on the item?

If they have improperly branded an item then they have broken a rule. However, you have listed against that listing and so are also at fault. You can’t really appeal that as you should not be on that listing.

I think you are not understanding the branding.
The product may look the same and may even be made in the same manufacture.
Once the seller list under their brand you cannot list it. That seller is taking the responsibility of advertising, marketing and customer service and safety issues. No seller is going to spend time and money to advertise their products and then let everyone else sell them.

I agree with trying to rebrand branded products such as Cadbury.
The issue starts when rebranded Cadbury is advertised more by that seller so comes up at the top of search under Goole and Amazon so more sell. Amazon is trying to remove products when one is reported but from all 000’s sellers listing products everyday it is very difficult to control. With small brands Amazon is not going to get into correct brand owner.
