HFSS & Ads Issue?

So our product has been listed with Amazon for almost a year now. Previously we fulfilled our orders with a 3PL distributor but last month switched to FBA. Now Amazon is blocking our Ads due to 'HFSS restrictions'.

I've seen this has been an issue for many so I'm wondering if others have resolved it & how? Its been almost a month with absolutely empty assistance from the 'support team' so we're completely lost.

Our product is a cocoa flavoured powder supplement with vitamins & minerals, containing about 9kCal per serving so nowhere near any potential HFSS restriction, in fact our score is -4 but we are unable to list that as an option.

Does anybody have any experience on how to update their product listing correctly so this massive inconvenience can be removed? Our HFSS status is now currently locked as 'not in scope' & we've not been given any guidance as to why or even if this is correct?

You are not the only one.

@Julia_Amzn seems to be on the case. We also have an appeal with the ads team, which appears to be dragging on.

If it's of any comfort, there seem to be a number of sellers affected by this. It must also be said that Amazon is breaking the law by in effect favouring some suppliers over others, through this humbug approach to HFSS. (Section 2 of the competition and markets Act).

This asin concerned was 'Healthy' (as advised last time this occurred) but we used a flat file to change it to 'Not In Scope'. Seller support has told me it's fine but advertising support have contradicted this many times. And keep telling me to jog on back to seller support....who tell me it's all fine and to talk to ad support. It's like being in a weird nightmare.

In our case, it's our best seller which has been blocked from advertising, which is a very serious matter for us. Whilst our main competitor on this line is able to advertise (hence the legal twist to this).

We actually replicated the product several days ago, i.e. set up the same item again.. You could argue this is pointless, but I wanted to see if we could advertise them and whether we were missing anything obvious in the product details area. These items are being advertised with no issues. It's only FBM however. I don't want to have to relaunch a product because it will cost us a fortune in PPC so close to xmas, and of course our excellent customer reviews built up over 2 years on the product will not count.

So we have a bestseller blocked from advertising (wrongly) and we have the exact same product that can be advertised. It's a sorry mess created entirely by Amazon, and we are the ones who suffer as a result.

We are writing to Amazon's Legal Department in London, which will be sent tomorrow if there is no resolution by then. In addition, we are also writing to the Competition and Markets Authority and the Small Business Commissioner.

I would also point out that there was an article in The Grocer almost exactly 2 years ago related to the same issue (we suffered then, too)

Amazon has not learnt and is hurting sellers again.
