Counterfeit Without Test Buy Claim

I have recently received a counterfeit without test buy claim against an item I am selling. Most of my inventory comes from sources like garage sales, second hand shops ect and I found this item brand new recently. It is not fake but instead of changing the product so you need to request approval, the rights owner said anything not sold by them is fake.

I don't have documentation to be able to appeal the claim, what happens if i click the "I understand the policy and acknowledge the violation" instead of submitting documentation? Will i just lose the item or could my account get shut down?

In this case, even if you acquired the items in used condition, the rights owner has the prerogative to select authorized sellers for their products. If you are one of these authorized sellers, you would need to provide documentation showing that the rights owner has granted you permission to commercialize their products.

The documents are:

1. Invoices proving the authenticity of your products (you may remove pricing information); OR

2. Amazon order IDs demonstrating product authenticity; OR

3. A licensing agreement or an authorization letter from the rights owner (cannot be a forwarded email); OR

4. A court order finding that your product does not infringe the asserted IP, or that the asserted IP is invalid or unenforceable.

In this case, you are basically acknowledging that you violated Amazon's intellectual property policy and you will be unable to sell the item again. This will remove the violation from your account and will not deactivate your account.
