I have submitted an IP complaint for design patent infringement: 17723575011
This is the exact same product that keeps popping-up on Amazon from different sellers over the last few years. All of them have been removed previously. I just saw this new item listed and reported it. Within an hour Amazon replied back stating:
"Thank you for your report of infringement. We cannot take action on your report for the reasons listed.
We reviewed your notice of infringement and determined that the products that you reported are not substantially the same as your patented design. If you believe that this decision was made in error, resubmit your notice of infringement with the intellectual property report that you believe is being infringed upon and the corresponding ASINs.

This is a clear infringement and has been proven in previous complaints prior to this. Can you please re-assess this and get back to me on a resolution.

I cannot provide any legal guidance on how the complaint was not accepted, but I can escalate if the re-review process fails to see if I can initiate a re-review process.
However, it seems like this case 17737437221 is still under review and you brand registry report a violation submissions are also under review.
