VAT refund problem

Hello

Trying to claim my VAT refund on selling fees for the period I wasn’t VAT registered.

Been selling on Amazon since 2018 and went over the turnover limit late 2022, became VAT registered on 01/12/2022 and received and submitted my VAT number to Amazon on 03/02/2023

From my understand Amazon should refund me from May 2020 (due to 4 year statute of limitations) to 01/12/2022 (date I became VAT registered). Is this correct?

Amazon asked for my tax returns which I submitted. The problem they think since my turnover was over £85k in 22/23 return that I am only due a refund up to the start of 22/23 tax year. They seem to not realise the £85k limit applies to the previous 12 month and not to a tax year.

I have tried to explain this to them but receive.

“As informed previously, we found that your annual turnover for the Tax Return 2022-2023 was more than 85,000 pounds hence we cannot include this period (April 2022-April 2023) into our refund calculation.

Hence, the refund date range will be from 01/05/2019 - 31/03/2022.”

Am I correct in this, and how can I make them understand?

I am not sure why turnover is an issue. If you can prove you are a business, even if not VAT registered, or if you are registered and provide Amazon with your number, they can reverse charge the VAT on Luxembourg issued invoices. Any invoices where LU VAT has been charged, you may be able to claim the VAT from Amazon. Any UK invoices will have VAT regardless.

I'm stuck.

Support are saying the same thing over and over again.

"While checking with document such as Tax Return 2022-2023, we found that annual turnover is beyond 85 pounds which is ---- hence this is the reason we cannot include this period (April 2022-April 2023) into our refund calculation."

This doesn't make any sense.
