this is my appeal and they seen saying " we have spoke to our legal team about this and have determined the ASIN cannot be appealed" I have send them images of their own policy showing they are incorrect and images of equal items being stocked in the uk by amazon them selves.

You should quote the portion of the policy you're referring to and provide a link to it.
You also should cut out the unnecessary bits, e.g saying you're committed to obeying Amazon regulations.
You should also re format into the 3 part format Amazon expect. If you're saying the products don't have Tobacco you also need to include evidence that they don't. You should also check the listing to see if there was anything in there that might make them think it has Tobacco involved.
Lastly, are you sure it's the Tobacco angle they have an issue with? It seems like they're saying the product isn't legally allowed to be sold, so you should make sure there isn't something else Amazon thinks is wrong.
