How to report test buy for unauthroized seller offers in Report Violation Tool?

We are FBA seller with a registered and USPTO trademarked brand on Amazon with no authorized sellers besides ourselves. Since our products have become best sellers, multiple unauthorized sellers have started listing FBM offers under our ASINs at significantly lower prices. This has caused us to lose the featured offer and significant sales. We have filed complaints through the Brand Registry and Abuse departments, but all have been rejected without clear instructions.

We are now conducting test buys, but there doesn't seem to be a clear process for this in the Report Violation tool under Brand Registry.

Questions:

1. I can select a seller’s offer for our ASIN, report it as counterfeit, and provide the order ID and a description. However, how do I upload images of the test buys to prove the counterfeit products? There doesn’t seem to be an option for this. Our products are shipped with our brand packaging (box and inner wrapping), whereas the unauthorized sellers are providing generic products that look similar but without our brand packaging.

2. The unauthorized seller has marked the product as non-returnable. Can I still return the product, and should I contact Amazon customer service (as a customer) to report this issue?

Unfortunately, the Report a violation tool does not support image uploads. Sellers will have to describe in the details how the product is infringing the IP.

This is already a request made by sellers and myself to the report a violation tool, and the team is looking to implement these requests in the tool in the future.

You can also use the Report intellectual property infringements tool as well.

As each sellers product and return is different, please work with the customer service team to report and receive a refund.
