Amazon Inadequate return protection destroyed my products

Amazon FBA returned my products to me and wrapped the products improperly. Leaving a big hole in the top of the wrapping allowing water to get in very easily.

I contacted Amazon regarding this and they say they take zero responsibility for it due to I allowed the carrier to leave the package outside. If the package had been correctly wrapped this would not of been an issue, I have had this before with no issues. However, the packaging was wrapped in a way that the top left a hole/ gap for any downwards water to get in. Not clearly outlined when dropping off the pallet.

What are my rights as a consumer in regards to the carrier service failing their duty of care when providing me a safe and secure return for my products. Basic level of environmental protection should be a minimum.

If one of your packages had arrived at a customers like this, Amazon would say this is your responsibility. Shame it doesn't work that way when Amazon is the sender.

First thing to say is that you are not consumer buying a retail item so you would not receive that level of protection. If you are/were a seller on Amazon then this will be considered to be a B2B delivery and in fairness that looks much better wrapped than 99% of the pallet deliveries that arrive at my warehouse.

From the time it gets delivered neither Amazon or the carrier will be held responsible for the weatherproofing of your delivery unless otherwise promised. If you can prove they were wet before delivery (e.g. photos immediately after delivery) you have a case against the carrier but if the goods got wet by being left outside after delivery you have no case.

I appreciate in this environment this post maybe unpopular but might save you some legal fees. Check the exact wording used by Amazon in their FBA returns terms, unless they specifically state the goods will be weatherproofed I suspect your case will be thrown out. Sorry.
