Account deactivated due to counterfeit claim by competitor who created the listings not the rights owner

Hi I have a account deactivation after 3 critical counterfeit violations on my account for the same product which has 3 or 4 different colour ASIN variations, but I am an official authorised reseller for the brand and product.

The issue is the listing I listed under looks like an official listing for the product with official brand and product title and images, but I have since noticed it is an unauthorised brand and competitor of ours who have created the listing. They are also authorised resellers of the product like us and buy from the same official brand rights owner and distributor as us - they stated where they bought from in the counterfeit claim.

I submit invoices from the rights owner and official distributor of the brand but they are rejected every time as Amazon say I need them to be from the unauthorised brand who created the listing and who Amazon thinks is the brand and rights owner to the products for these ASINs, they quoted ther trademark for their own brand name in the counterfeit claim.

I have emailed the unauthorised brand who claim they are the rights owner to the products and attached invoices from the same official distributor we both buy from, saying ours are definitely not counterfeit, and to ask them to request the voilation be retracted, but receive no responses back and our account remains deactivated.

I am in touch with the rights owner and official distributor of the brand - what is the best course of action for them to take? They can have the 3 ASIN listings removed as the rights owner of the brand and product, but that will not help removing the 3 critical counterfeit claims on my account from this unauthorised brand? They could contact the unauthorised brand but what if they don't reply like they don't to me? They are not selling any other products from this brand.

have you checked what ean is on the asin

and does it belong to the true brand owner or the competitor

it sounds like you have a competitor who has gamed the Brand Registry system unfortunately. If you are willing to share an ASIN that can be confirmed. Are the products themselves barcoded?

As for next steps, I would say you could discuss this with the distributor who may not be happy to have their products misrepresented on amazon. They could push back to the other seller and state they can’t sell to them unless this is resolved.

You could also try mediation (look it up on seller central) as that is supposed to enforce a third party to look at the evidence (which we know seller support won’t)
