Correcting Brand on Product Listing Added by 3rd Party Retailer

Hi there,

We are a manufacturer and brand owner. A 3rd party retailer has added one of our SKUs/ASINs to Amazon, however instead of listing the product against our registered brand they have simply listed it under "Spirit" (we are a whisky & gin distillery).

I've contacted Amazon support who tell me that despite us being the brand owner for the product, the listing cannot be updated from "Spirits" to our brand to allow us to update the product data etc.

Is this correct? The product is very clearly ours with the brand name being in the item name amongst other places.

This was the (typically unhelpful) response from Amazon support:

"As per your information, we have checked and confirmed that you registered the brand name {Your Brand}.

However, the ASIN has been listed under the Existing brand "Sprits" that is why we are unable to change the brand name to {Your Brand} as per our brand name policy.

Hence, we're unable to complete your request by make the suggested brand change to ASIN.

To protect Customer trust and ensure catalog quality, Any major Brand Name change requests are considered re-branding and will not be supported."

Is this all correct? How is having the wrong brand listed on a product protecting "Customer trust and ensure catalog quality"?

Do we need to just leave this listing with the incorrect brand and if we want to sell this product add a whole new duplicate listing?

Many thanks,
