VAT establishment HELP!
Amazon have sent me a notice stating the HMRC have notified them that I am not established in the UK however after contacting HMRC they have said we have done no such thing and have not sent a notice to Amazon.
Amazon have blocked by disbursements and the ability to buy shipping labels.
It is so frustrating to deal with Amazon as you get nowhere. I have sent certificate of my VAT registration and they have rejected this. Furthermore Amazon have requested that HMRC need to provide us proof in writing that we are UK established however HMRC have stated we have never done this before and not do we do this.
HMRC stated that anyone that has a UK VAT number is VAT registered and so there is no such thing as confirming if you are established in the UK.
Amazon have created this themselves and have made it even harder to resolve the matter as they are requesting for something the HMRC have stated they do not do.
Any sort of help will be amazing.
Kind Regards

Someone last week mentioned on the forums they had the same message, and 4 days later there was account was back to normal, they thought it was a glitch/amazon error. Like you they contacted HMRC and were told they had sent no notification to Amazon.

Hello @Seller_2EjL88l0NNfWJ,
I'm Sarah with Amazon.
I checked with the partner team and I was informed that they have sent you a performance notification yesterday explaining why the documents provided are rejected.
Have you had a chance to review it?
Kind regards,
Sarah.

"HMRC stated that anyone that has a UK VAT number is VAT registered and so there is no such thing as confirming if you are established in the UK."
HMRC won't have said that and if they said something similar, you will have misunderstood.
This is a summary for determining establishment (taken from ChatGPT but lots of other official resources available):
--------------------------------------------------------
In the UK, a company is considered established for VAT (Value Added Tax) purposes based on certain criteria. Establishment for VAT can depend on the nature of the company's presence and activities in the UK. Here are the key factors that determine whether a company is established for VAT purposes:
1) Place of Business: A company is typically considered established if it has a fixed place of business in the UK where it carries out its business activities. This could include an office, branch, or other permanent premises.
2) Human and Technical Resources: The presence of human and technical resources in the UK that are essential for conducting the company’s business operations is another key factor. This includes having staff, management, or facilities in the UK.
3) Decision-Making and Central Administration: If key decisions regarding the business are made in the UK or if central administration is carried out there, this could indicate that the company is established in the UK for VAT purposes.
4) Economic Activity: The company must be engaged in economic activity in the UK, such as selling goods or services, in a way that is more than just ancillary or preparatory.
5) VAT Registration: If a company meets the VAT registration threshold through taxable supplies made in the UK, it must register for VAT and will be considered established for VAT purposes.
A company can also be considered established for VAT purposes if it does not have a physical presence in the UK but carries out regular economic activities through agents or representatives.
These criteria are used by HMRC (Her Majesty's Revenue and Customs) to determine the VAT status of a company operating in the UK.
