Brand Registery Request Rejected Imediately Multiple Times With A Template Message

Hi Sellers and Amazon Brand Registry Team,

I've recently tried enrolling my brand in amazon brand registry multiple times but every-time I submit the required information the request gets rejected instantly. I'm providing all of the required documents as well as product images clearly showing brand name and logo permanently attached to the product.

The paperwork is complete and my application is pending at USPTO, my attorney used is a US bar member and hasn't been black listed or flagged by USPTO or amazon for filing applications.

I've tried appealing the rejection multiple times but I'm getting an automate template response that doesn't describe my problem and gives a vogue list of possible reasons none of which actually qualify upon reviewing. I've requested for a manual review but I'm getting the same template forwarded to me multiple times.

I've also tried resubmitting the documents after remaining them as to ensure that the documents are properly reviews and aren't auto rejected by a bot.

Have anyone faced such issue, how did u manage to solve it and get registered???

Wonderful. Does everything match EXACTLY everyplace?

This is a template -- use what fits your case.

Here are some of the most common issues with BR.

Go over everything with a magnifying glass looking for a missing 'period' or 'comma'.

Is there a different capitalization, abbreviation, spelling, or, even an extra spa ce?

Is your Brand registered (or applied for) with the USPTO?

Amazon is admitting applicants under CERTAIN conditions when only filed but not granted.

This is from Sandy_Amazon on 5/16/2023

“To be eligible for Amazon Brand Registry, your brand must have an active registered trademark in each country where you wish to enroll or have a pending trademark application filed through Amazon IP Accelerator. Brand Registry is also accepting brands that have a trademark pending registration in a subset of trademark offices.”

Additionally, IF you ever get an actual TM (if you don’t now) When Amazon says something must match they mean EXACTLY!

That means Street is not ST.

Jim is not James.

ALL CAPS is not SOme CAps

Thanks to Sandy_Amazon for letting us all know that applications are also space sensitive.

And so on………………..

They mean every comma, period, dash, etc. must be EXACTLY THE SAME INCLUDING SPACE S.

Go over everything with a magnifying glass looking for a missing 'period' or 'comma'. Is there a different capitalization, abbreviation, spelling, or, even an extra spa ce?

What is the EXACT BRAND (as GRANTED) on the USPTO site? Is it the EXACT same as the Brand on the Amazon account AND the brand on the packaging?

What is the name of the Owner (REGISTRANT) on the USPTO site? Is it the EXACT same name as the owner of the Amazon account?

If it is NOT exactly the same you will need to show some proof that the two are the same as to ownership! Because I manufacture under one LLC and sell under a different one, I had to submit my LLC State Registration with MY name as the owner of the LLCs showing the common ownership.

The OWNER of the Brand is the one that MUST enter into the Brand Registry agreement. If the owner is not the same as the Amazon seller the seller will have to be granted access by the owner AFTER REGISTRATION.

You might have to take a picture of the item while holding it in your hand (unless it weighs 1000 pounds!)

Amazon can be 'weird' at times and I have seen where they ask for a handheld picture.

In addition, on one post @jim_amazon added this interesting reason for a rejection!

“One other piece of advice, I've some applications have issues when the 'Suggested ASINs' list is filled out incorrectly so I recommend leaving that section blank!”

“In the interim, @NEVERLAST is spot on with making sure your application matches with USPTO exactly. The 2 areas I see the most common errors (for US TMs) are the Trademark type not aligning with the what can be accepted for enrollment. You can check this out on the Enrollment guidelines for the US help page. Or, the current owner information tab in USPTO does not align with what you have submitted for you application, to include any attachments. “

Typically when sellers receive this messaging it could mean 2 things:

1. The seller themselves has engaged in abusive conduct

2. The trademark/brand is abusive.

For 1.Some sellers will have Account Health metrics they will need to work on, or have other selling accounts they opened in the past/present that in bad standing. (deactivated, terminated, not meeting account health metrics, unresolved claims, etc.)

If you do not fall under all things listed in 1, the reason for decline could be for reason 2.

For 2. Trademark reason, if sellers are working with an attorney or agent that violates United States Patent and Trademark Office (USPTO) rules and policies, this will prevent you from enrolling in Brand Registry.

If you’re working through an intermediary, rather than directly with a U.S. licensed attorney, to seek a U.S. trademark registration or enrollment into Brand Registry, your application may be subject to additional investigation by Amazon and the USPTO.

Please check whether your attorney is a subject to an Order for Sanctions from the USPTO or listed on Potentially Misleading Solicitations. If you’re concerned about the validity of your application or the conduct of involved parties, please consult with a new private U.S. attorney to review your application.

If you review 2 and are sure that your attorney is not sanctioned by USPTO or Amazon, please appeal your case and apply again.

First off, the team usually won't give any further information outside of what you've gotten in order to protect their processes around abuse prevention; I myself only have access to the same info they gave you in your case. That being said, when sellers receive the same messaging it typically means one of two things:

  1. The seller themselves has engaged in abusive conduct
  2. The trademark/brand is abusive.

For 1. If sellers have been selling for awhile, some sellers will have Account Health metrics they will need to work on, or have other selling accounts they opened in the past/present that in bad standing. (deactivated, terminated, not meeting account health metrics, unresolved claims, etc.)

The OWNER of the Brand is the one that MUST enter into the Brand Registry agreement. If the owner is not the same as the Amazon seller the seller will have to be granted access by the owner AFTER REGISTRATION.

You might have to take a picture of the item while holding it in your hand (unless it weighs 1000 pounds!)

Amazon can be 'weird' at times and I have seen where they ask for a handheld picture.

In addition, on one post @jim_amazon added this interesting reason for a rejection!

“One other piece of advice, I've some applications have issues when the 'Suggested ASINs' list is filled out incorrectly so I recommend leaving that section blank!”

Additional comment from @dougal_amazon on rejections --

“In the interim, @NEVERLAST is spot on with making sure your application matches with USPTO exactly. The 2 areas I see the most common errors (for US TMs) are the Trademark type not aligning with the what can be accepted for enrollment. You can check this out on the Enrollment guidelines for the US help page. Or, the current owner information tab in USPTO does not align with what you have submitted for you application, to include any attachments. “

Typically when sellers receive this messaging it could mean 2 things:

1. The seller themselves has engaged in abusive conduct

2. The trademark/brand is abusive.

For 1.Some sellers will have Account Health metrics they will need to work on, or have other selling accounts they opened in the past/present that in bad standing. (deactivated, terminated, not meeting account health metrics, unresolved claims, etc.)

If you do not fall under all things listed in 1, the reason for decline could be for reason 2.

For 2. Trademark reason, if sellers are working with an attorney or agent that violates United States Patent and Trademark Office (USPTO) rules and policies, this will prevent you from enrolling in Brand Registry.

If you’re working through an intermediary, rather than directly with a U.S. licensed attorney, to seek a U.S. trademark registration or enrollment into Brand Registry, your application may be subject to additional investigation by Amazon and the USPTO.

Please check whether your attorney is a subject to an Order for Sanctions from the USPTO or listed on Potentially Misleading Solicitations. If you’re concerned about the validity of your application or the conduct of involved parties, please consult with a new private U.S. attorney to review your application.

If you review 2 and are sure that your attorney is not sanctioned by USPTO or Amazon, please appeal your case and apply again.

First off, the team usually won't give any further information outside of what you've gotten in order to protect their processes around abuse prevention; I myself only have access to the same info they gave you in your case. That being said, when sellers receive the same messaging it typically means one of two things:

  1. The seller themselves has engaged in abusive conduct
  2. The trademark/brand is abusive.
