Can I restrict other sellers from my branded listing in this case?

I have an ASIN/Listing that has my brand name on it and it points to my store. I am not winning the buy box because lots of other sellers are on the listing and some of them are cheaper. We are selling a product that is from another brand. It is a well known brand. We have permission to sell but we are not selling under their branded listing but our own.

Can I file an infringement case with brand registry to get the others off my listing? We are up to 32 other sellers currently. I usually just tell BR that others products are pretending to be our brand and cant be as we don't offer resellers. In this case, we are offering a product from another brand.

My name is Sandy from the Community Manager team.

Amazon's policies allow any seller to list items for sale on an ASIN so long as the intellectual property accurately represents the item being sold and has not been illegally reproduced. This includes intellectual property for which you are the rights owner.

In addition, Amazon respects a manufacturer's right to enter into exclusive distribution agreements for its products. However, violations of such agreements do not constitute intellectual property rights infringement. As the enforcement of these agreements is a matter between the manufacturer and the retailers, it would not be appropriate for Amazon to assist in enforcement activities.

If you believe that these sellers are items that are illegally reproduced, please perform a test buy and report to Amazon ONLY facts and proof of why they are illegally reproduced.

With 32 other sellers on the listing, I'm assuming it is a competitive and popular product. Test buys are the standard way to report these, but I understand reporting 32 sellers is very hard to do.

In my opinion, I think it would be best to talk to the brand owner to see if you can sell under their branded listing as an authorized reseller. To further protect the listing from counterfeit I would also suggest looking into Transparency as well.
