Trademark misuse

I am dealing with very weird issue. Amazon recognised the word Amsterdam as a trademark in my title, out of any context of the trademark. I sell painting by number and the title contain the word amsterdam at the painting is related to the city amsterdam the capital of holland. I tried to discuss it many time with the support in emails, chat and phone call, without them getting that this is nonsense. Like forbidding someone to sell a painting of Red Apple, just because the word apple is a trademark.

I got it with other word too, like the word Sargent, a name of a public domain painter, that amazon recognised as a trademark due to a brand with this name. And also with the word Hudson in a painting of Hudson streamliner locomotive even though it was named after the Hudson river.

Don't know what else can I do for them to understand

Hello @Seller_uZ9xtKUXAVuZT,

Thank you for posting on the Seller Forums.

"Amazon recognised the word Amsterdam as a trademark in my title, out of any context of the trademark."

From what you have posted, this sounds like a suspected intellectual property violation for trademark misuse. Typically, if you have a trademarked term, logo, or picture in a product detail page and the brand name in the listing does not match the rights owner of the trademarked content, these violations can occur. While I understand that the use of the trademark "Amsterdam" is being utilized out of context, it does not negate the trademark status on the term. Therefore, our team will still require the violation to be address in one of the following ways.

To resolve the issues, you will have a few options. First, you will have the option to click "edit" next to the violation and either remove the trademarked content or edit the listing to show the proper brand name for the trademarked term. Once the listing has been corrected it can take up to 24 hours for the listing to be reinstated. Second, you will have an option to dispute that the listing has been deactivated in error. In a dispute, you want to provide proof that you have the rights to use the trademark in the listing- example: letter of authorization or licensing agreement. For this, you can create a case and attach the dispute documents for review.

I hope you find this information helpful, and remember the Seller Forums community and I are here to support you. If you have any further questions or updates, please feel free to respond in this thread.

Wishing you the best,

LeviDylan
