Trademark Logo Misuse - But We Own that Trademark! It is LITERALLY OUR BRAND NAME!
"Trademark Logo Misuse"
We are a registered Brand with Amazon under our trademarked brand name. Our Amazon account is named after our trademark, and we own all the rights to it.
Recently, 3 of our listings were removed due to "Suspected Intellectual Property Violations (Trademark Misuse)." All of these violations are flagged as having a "High" impact on our account health. We were able to find a human on the other end to actually remove 2 of these issues. 1 issue remains and we are getting the same response every time.
We opened a case (Case ID: 18005089651) and in the case, we clearly stated that we are the rightful owners of the trademark. We've also attached our trademark documentation and a Letter of Authorization (from our OWN COMPANY) multiple times. Despite this, every response we've received has been generic and does not address our specific situation.
Each response from Amazon is:
"We understand your concern regarding the intellectual property violation for ASIN B01N1OZ5N8. After reviewing your case, we found that your listing uses protected trademark terms of Oceanic Water Systems.
To resolve this issue, you need to take one of the following actions:
1. If you want to continue using the Oceanic Water Systems brand name:
Provide a valid letter of authorization or licensing agreement that proves you are authorized to use the Oceanic Water Systems trademark. The documentation must include all required components as detailed in our Letter of Authorization guidelines: https://sellercentral.amazon.com/help/hub/reference/GUF78PCXAMHDY2A6
2. If your product is an accessory for Oceanic Water Systems products:
Update your product detail page (title, bullet points, description) to use compatible terms according to our policy: https://sellercentral.amazon.com/help/hub/reference/G201361070
3. If your product is not related to Oceanic Water Systems:
Remove all references to Oceanic Water Systems from your product attributes."
We have provided the LOA at least 10 times now.
Please help with this, it is driving me crazy!

Who handled your Brand Registry application and manages it now? Is it a different person/entity than your selling account?

HI @Seller_1iIOjkcesfNu4
I heard back from the specialist team. Please see below.
The ASIN is not suppressed due to trademark issues.
Based on our investigation, this product has been identified as an appliance that is not in compliance with current California state regulations. In California, certain products must meet minimum efficiency requirements determined by the California Energy Commission (CEC). Although permissible for sale on Amazon, products that do not meet the CEC's minimum efficiency requirements cannot be sold into the state of California.
It seems like this ASIN was suppressed due to this reason and not the trademark. If you have any questions, please let me know.
Sandy
