Unfair A to Z claim, buyer did not return the item and got refund in full

The buyer filed a return request and did not ship the item back. Then he filed an A to Z claim because we cannot issue a refund without performing a return inspection. For some reasons, he won the A to Z claim and he still has not returned the item to us despite all the emails we sent him. Now he keeps his money and my item at no cost. I guess I have to get legal action involved if there is no help from Amazon Canada team.

Hi, did you approve the Return Request? Was it pre-paid? Also, what is the stated reason for the Return Request?
I had a very similar situation recently, but Amazon asked the buyer to send the item back. Then upon receipt, i refunded with no ODR impact. The way it should be! (By the way, this was for an item that had no tracking!).
I did approve the Return Request a few hours after it was made. Also, at first the buyer claimed "found better price" for the Return Request, then stated "defective" when he filed the A-Z. While waiting for the return, I called Seller Support who assured me my ODR would not be impacted, and that was the case. I did notice while I was waiting for the return, the status of the A-z changed to "Withdrawn".
Don't be discouraged, though I know a lot of sellers have bad experiences with A-Zs.
Do you have a chance to appeal? If so, don't assume your communication with the buyer would be read. Cut and paste if you have to. And assume your appeal (and attachments) would be looked at. Good luck.
