It is too RIDICIOUS : The brand and brand account suspend by Amazon but seller perfroamnce said: There is still COUNTERFEIT
Hello,Sir/Mandon
I think, it is too RIDICIOUS : The brand and brand account suspend by Amazon but the competitor seller still can stubmit counterfeit complain? To IP issue, the premise is that : Your IP (Patent, copyright, trademark) should be protected by Amazon, Now AMZ suspend their brand and account, but seller performance said : This is still counterfeit?
Did the counterfeit review department knows what counterfeit is?
Amazon should investigate immediately.
Tks

Hello @Seller_LmVi4jw3KN7eX
Thank you for the information regarding the suspension of the brand account. I understand it is due to counterfeit concerns with the product you are selling. When infringement is reported as occurring on intellectual property that has already been properly registered, our team must take action to ensure that all policies are being followed. This may require asking you to provide documentation such as an invoice, letter of authorization, or a licensing agreement from the brand involved.
If you believe that the complaint is false, you would need to provide documentation or other evidence to show this. The submission will be reviewed and the appropriate action taken. However, we ask that you remain aware that if the documents are not sufficient, we cannot guarantee a resolution to the counterfeit claim.
What type of information have you attempted to submit as of now? In addition, please provide screenshots of any messaging you have received in response so we may better assist.
Additionally, I have transferred your details for a member of our account health team to contact you for a more in-depth conversation. Please ensure you details are up to date so they may reach you.
Best,
Atlas

Hello @Seller_LmVi4jw3KN7eX,
Thank you for providing more information, for us to review.
I have a few follow-up questions for you. In the performance notification you received titled "policy warning", did you receive information about the rights owner making the complaint? example: their trademark number, contact info, etc. I understand that their brand may not be enrolled in the brand protection program, however, if they have a valid trademark registered on the uspto.gov website, the complaint may be valid. I suggest to check the trademark to find out if it is live. Once you have checked this, please feel free to respond with updates in this thread.
Wishing you the best,
LeviDylan

Hello @Seller_LmVi4jw3KN7eX,
Thank you for following up in this thread.
For the IP-counterfeit violation, you mentioned that you have submitted a verifiable invoice from the same manufacturer. Is the manufacturer also the brand owner? Do the invoices meet our document requirements? I suggest to double check the invoices against the requirements in the help page above, to see if they match up. If one requirement is not met, the submission may be denied. If the invoices are not accepted for any reason, then you will be asked to submit a letter of authorization from the brand.
When it comes to a product authenticity complaints, you will be asked for invoices, supply chain invoices or a letter of authorization that prove authenticity of the product. Again, the invoice that you submit must meet our document requirements. I will list the below for your reference:
-Copies of invoices, receipts or other similar documents that demonstrate where your products are produced or manufactured
These documents:
-Should reflect the sales volume of your product across all Amazon marketplaces in the last 365 days
-Should demonstrate your product’s full supply chain
-Should include contact information for the supplier(s) and the original manufacturer. We may contact suppliers or manufacturers to verify the documents
-Your documents should be able to trace your products to the original manufacturer even if you did not purchase them directly from the original manufacturer. This may require requesting additional invoices or supply chain documentation from your supplier if you are not sourcing directly from the manufacturer.
-You may remove pricing information, but the rest of the document must be visible to enable adequate review of the documents you provide. For ease of our review, you may highlight or circle the ASIN(s) under review.
For each of these issues, if you believe the complaints a placed in error, you will be required to submit a valid dispute. What proof do you have that the complaint is invalid? Stating that the rights owner is not enrolled in brand registry will not be an acceptable reason that there has not been a violation of the policy.
Do you have proof that the brand does not have a valid registered trademark? This is the type of information that would be required.
I want to ensure you are provided with the best support possible. For this, I am going to forward your information to the Account Health Support team. Please ensure your contact information is up-to-date as they may reach out.
Please feel free to continue to reach out in this thread for further assistance. The Forums community and I are here to support you.
Wishing you the best,
LeviDylan
