Approved for GTIN Exemption, Brand Changed, Account Deactivated

Hey, so my issue is actually incredibly weird and I'm not even sure how it got to this point but I will do my best to explain what has happened and what's going on for some possible clarity.

I had a listing which was basically Pokemon cards under the brand "Generic". I tried to use the word Pokemon in the listing and it was flagged for intellectual property (just a warning at the time) so I removed all wording relating to "Pokemon" from the listing & it was good to go.

I was then approved for a GTIN exemption to create new ASINs under the Brand Pokemon and I thought

"Why not ask Customer Service if I can get my current ASINs moved to Pokemon since I was approved for the exemption"

I get on CS, and I spoke to an extremely kind gentleman by the name of Vivek who helped me move my ASINs to the brand Pokemon. I asked him;

"Can I use the word "Pokemon" in my listings now since we were able to change the Brands to Pokemon?"

to which he replied;

"Yes"

I updated my listing to have this wording, and to my surprise - even under the brand Pokemon, the listing was flagged for IP and my account was deactivated.

I stated the issue in an appeal and apologized for anything I may have done wrong mistakenly, and my current appeal has been under review for a whopping 4 days now.

I have all of the case logs and evidence proving I was approved for the GTIN exemption, but when I try to talk to Seller Support, they're saying my application was rejected. I am just extremely confused at this point to be honest, and I would love to continue to try to provide more information regarding my business/product to Amazon Support, but I can't add more than 1 appeal at a time, and it's been extremely difficult with the prolongued appeal review (4 complete days now).

This is indeed an extremely odd situation to be in, and I feel almost helpless at this point with no one to turn to except for deactivated account Seller Support who just tells me to "Wait".

Your issue is that Amazon CS doesn't know what they are talking about half the time, ASIN's (from my understanding) can't be moved to a new brand, they have to be re-created and you can't sell Pokémon anything unless you have authorization from Pokémon.

1. a glitch in the system. For branded products a "GTIN exemption" is not possible.

2. a violation because you are not the brand owner of "Pokemon" nor do you have a letter of authorization. That was a violation. Lucky you - your account was not suspended.

Hey @Atlas_Amazon, during the time of the IP violation - the listing was under the brand Pokemon, not "Generic".

I was also approved for a GTIN exemption/catalog authorization moments before the brand was changed internally.

Not only that, but I was also given permission by an Amazon rep to use the term Pokemon on the listing as well..

I'm confused as to why all of my appeals are still declined due to these facts. And if anything, I have stated multiple times in the appeal process that I am more than willing to stop selling this ASIN/Pokemon in general on Amazon - yet my store is still deactivated.

I understand the situation regarding the LoA, and honestly - I really don't think that's the biggest issue in the appeal process. No one who is selling Pokemon on Amazon right now can get an LoA from Pokemon even if they tried - and if they did.. It's fraudulent.

I'm confused as to why all of my appeals are still declined due to these facts. And if anything, I have stated multiple times in the appeal process that I am more than willing to stop selling this ASIN/Pokemon in general on Amazon - yet my store is still deactivated.

I understand the situation regarding the LoA, and honestly - I really don't think that's the biggest issue in the appeal process. No one who is selling Pokemon on Amazon right now can get an LoA from Pokemon even if they tried - and if they did.. It's fraudulent.

Hey @Atlas_Amazon, during the time of the IP violation - the listing was under the brand Pokemon, not "Generic".

I was also approved for a GTIN exemption/catalog authorization moments before the brand was changed internally.
