How to resolve hijacked brand without brand registry?

I've been selling a product where I'm the authorized reseller for several years. Recently a Chinese brand hijacked one of my listings and I now need approval to sell/edit one of the products. To make it a little more complicated, the manufacturer has tried to register a trademark, but there is another trademark already registered (but for very different types of products), so they haven't been able to register the trademark. That being said, the name of brand is on the product, they've been selling for years under this name. But because they don't have a trademark they aren't able to register with Brand Registry.

I have tried in vain to resolve this with Amazon seller support. I've been on the phone with them, and the rep states to me that they clearly see that the product listing has been hijacked, but has to be escalated. Once it's escalated I typically get a response back saying we have taken action, but can't provide any details due to privacy. Or, they say to open an IP violation under Brand Registry, which of course I can't since the brand isn't registered. And the issue isn't fixed.

The product I'm selling is an electronics product, the hijacked "brand" is Nicbobo that is registered for leather products and sell random Chinese knock-offs. My product's UPC barcode is registered properly with GS1 and I can do a lookup to see that it matches the name of the product. I've been told by Amazon to delete my listings/product and enter it again, which I tried, but it made no difference since the UPC barcode is the same.

Any suggestions on how I can resolve this?

Hello @Seller_swXsyMDgjVx9G,

My name is Dougal from the Community Manager Team and I really appreciate the level of detail provided here and all the case ID's.

I was able to find out what is going on rather quickly and have submitted an escalation to remove "Nicobo" from the byline (link below the title) on the detail page.

For reference, the brand information on the ASIN itself is correct (seen below the byline). This store link is pulling from another location that needs to be updated as well and that is the internal request I have submitted.

Lately, these have been taking about a week to receive a response, but I will let you know as soon as I receive an update.

Best, Dougal
