I doubt that the MODS will have much to say about this since Brand Registry is not the most helpful system for helping smaller sellers.

You can look at this -- I have NOT done it since I'm kind of winding things down a bit for my branded items (at least on Amazon).

WHITELISTING

It seems clear that Amazon is only allowing MAJOR brands to 'whitelist' which sellers are authorized.

It was suggested by one of the long term experienced sellers on a different forum that the following has worked successfully in the past.

Have your attorney send a carefully worded Demand Letter (by Certified Mail) to Amazon’s "Office of the General Counsel".

I would think that you would want to include appropriate paperwork showing ownership of the TM from the USPTO, proof of registration in Brand Registry, and, any links to cases and messages that show that SO FAR Amazon has refused to protect your brand.

Basically, you need to put Amazon on notice that you expect the protections promised by Brand Registry.

AS @Seller_kIukTwdhvntApsaid, send your legal documentation to Amazon's legal office in Seattle, requestion the other seller be removed from your listings. Now with that said, there are some other issues to consider.

1. Brand Registry only does what it says, investigates brand ownership and accepts is as legally registered. Anything else is up to you to do.

2. How easy it for your branded products to be produced?

3. How many countries is your brand registered in? Brand protection in the USA only gore as far as the USA borders.

4. Foreign sellers may have the brand registered in their home country; if you do not own it there.
