Determination of "Establishment" for EU VAT (GmbH Registered Business)

Hi everyone

Following on from Amazon following the 2021 EU VAT on e-Commerce (EU VOEC) Legislation, they deducted the VAT from our account for sales dating back to July 2021 (even though we had correctly paid this to the relevant tax authorities).

We are a registered GmbH business, although we could not meet all of Amazon's documentation requests to prove the business was operated within the EU.

Has anyone successfully managed to get this VAT money back off Amazon on the basis that it has already been correctly paid to the tax authorities?

No tax authority is willing to refund this amount to us, and instead say that we are registered as a GmbH business and therefore Amazon should not be collecting this VAT.

We have tried countless times to email every Amazon email address we have and no one really understands the issue. Seller Support are of no help either.

I am sorry to hear that you're having trouble with the VAT process. You mentioned you couldn't meet all of Amazon's documentation requests to prove that the business was operated within the EU, why is that?

Did you receive any Performance Notification with instructions about what documents are needed in order to complete successfully the process? If you share a bit more information we will do our best to guide you.

Otherwise I also recommend to contact the Account Health Support, maybe even the German support team, if you are registered as GmbH, they can guide you through the process as they have more insight on the account. This team is available from 9 AM to 5 PM

Same VAT Issue with GmbH – Seeking Guidance and Support:

Hi everyone,

I’m experiencing a very similar issue with my Amazon DE account, which is operated under my company, FOB Europe GmbH. Despite being a fully registered GmbH in Germany and having paid all VAT liabilities to the German tax authorities, Amazon deducted €4,239.01 from my account.

I have provided Amazon with proof of all VAT payments to the relevant tax authorities and asked for clarification on how they will remit the deducted VAT to the authorities. However, the response I received was vague, and they mentioned that I need to reclaim this amount directly from the tax authorities via my tax advisor.

Unfortunately, like many of you, I am stuck in a loop where tax authorities say that Amazon should not be collecting this VAT, while Amazon insists that I must claim it back. I’ve been unable to get a clear answer on which document to submit or where exactly to apply for a refund.

I’d greatly appreciate it if anyone here has successfully resolved this issue and could share insights on the process or provide guidance. Did anyone manage to reclaim the deducted VAT from tax authorities, or perhaps escalate the matter effectively within Amazon?
