Appealing a Suspension
I was suspended about 2 years from a european market place, I didnt really appeal it I didnt really think I had a chance. However looking at some of the posts on the forum I am wondering if it is worth while appealing and if there are any template appeals i could use.Basically it was a trademark infringment, see below. However I must mention that this is a generic product that many many chinese merchants have put their generic trademark to.
Thank you for your message. Unfortunately, we can not accept your application because it does not refer to the message we received from the copyright holder. Please provide us with the following information so that we can process your request:
- proof of product authenticity (eg invoice / order number, license agreement, power of attorney). It must be clear that your products do not violate any intellectual property rights. Send this information as well as other documents and a list of affected ASINs to notice-dispute@amazon.de.
I have no way of providing invoices other than from my supplier, which i doubt will be accepted.
however further down the message it says
Has your offer been wrongly disabled? / Was your offer mistakenly deactivated?}
If you think there is a mistake, please explain why. Your statement should contain the following information:
- Why your offers did not infringe the brand’s intellectual property
Personally I think the merchant abused Amazons Brand Registry Policy, What are everyones thoughts is an appeal worth it ?

If you can’t provide invoices Amazon will accept, you can’t win an appeal.

It isn’t a question of what you think. What matters is whether you can supply evidence that the seller has abused the Brand Registry policy. But even if they have, proving another seller has done something wrong isn’t proof that you are in the right. Amazon’s policies make clear that it is the responsibility of every seller to research the items they wish to list to ensure they are genuine and do not infringe IP rights; and to be able to provide evidence of this if necessary.

If you don’t have any valid receipts or invoices, your last hope of a possible reinstatement would be to delete your entire inventory and then appeal with a good Plan of Action, promising Amazon that from now on, everything will be sourced from reputable suppliers and you will not infringe on intellectual property rights again.
Here is an example suspension appeal which talks about deleting the entire inventory and another one addressing intellectual property rights. You can write a similar one based on them, which will address your specific situation and then post it here for feedback:
