Brand Name Change on Listing - New "brand owner" hijacks listing name and alleges infringement.

I was selling generic misprinted metal pens on the following listing....

ASIN: B07DH787X7

SKU: 5lb Metal Pens - 120 FBA #2

Complaint ID: 16884175871

There was no brand owner when this listing started in 2018, in 2024 after this listing has been around for a while a competitor was able to claim ownership on the listing and add their brand name. They then submitted a complaint that I was selling their product and infringing on their trademark.

How can one add their brand to an existing generic listing? They are not following and Amazon rules and yet can mess with other sellers trying to abide by them? How do I get this complaint removed from my account? I have invoices, and when I started selling on this listing they were not the brand owner. Here are some facts, what am I able to do? Thank you

The "hijack brand owner" trademark registration (brand owner) was filed on 08/17/2023 and not registered until Aug 27, 2024

"hijack brand owner" was applied to an existing listing created in 2018.

"hijack brand owner" does not follow the following Amazon’s Brand registry and listing requirements:

Text-based or image-based trademark: The trademark for your brand must be in the form of a text-based mark (word mark) or an image-based mark with words, letters, or numbers (design mark).

Trademark match: Your trademark must also appear on your products or packaging and the trademark name must match the brand name that you provide in your Amazon Brand Registry application.

There is no "hijack brand owner" trademark branding or trademarks visible in the listing photos, packaging, or product on (ASIN: B07DH787X7).

I understand that you originally listed the product under generic, but since it has been claimed by another brand which has caused significant frustration to you. I do want to provide insight to your situation to assist you in navigating this type of concern.

While I understand the product had been initially added under the generic brand, if it had been claimed by a brand that has a pending or active trademark that does correspond to the details of the listing, then the complaint received would be considered valid. Our team will request that documentation is provided showing that the product is both authentic and authorized by the respective rights owner. If you do not have this, the only option may be to work with the rights owner to acquire a retraction.

I cannot guarantee a resolution will be available for your situation if you do not have verifiable documentation and are unable to get a retraction. I do encourage you to provide the details and information you have on this concern so I may continue to review and offer support.

This ticket is way too wordy and conversational. Subsequent appeals should be much shorter and just facts.

For instance...

Instead of: "How can one add their brand to an existing generic listing? They are not following and Amazon rules and yet can mess with other sellers trying to abide by them? How do I get this complaint removed from my account? I have invoices, and when I started selling on this listing they were not the brand owner. Here are some facts, what am I able to do? Thank you"

Just state the rule and how the other seller broke it in one short sentence.

Don't call the other seller "Hijack Brand owner;" call them by their shop name.

Your appeal should be 4 or 5 bullet pointed sentences.

Just my two cents.

You should probably go the route of trying to get it changed BACK to generic since the original listing was HIJACKED. Search the forums for the process to do this... there is a way, you have to get to a specific team that does this.

If you can get it changed back to generic (as it should be), then you can work to get the violation removed.

Lots of "brands" and I use that term loosely, hijack listings, change the listings, and steal the reviews. It's a process to get it reverted back, but can be done.
