Amazon officials have not been transferring money to the law firm to unfreeze my funds

Due to an employee error, my account was customized with a product name in the crate position, which happened to be trademarked “Frisbee” by a brand name company.

I received a TRO from a law firm on August 23rd and responded positively by contacting a Native American attorney to discuss a settlement.

On September 17, we finalized the settlement amount, and because the store name did not match the store name in the case, I was not sure if it had been modified, and chose to transfer the money directly from Amazon to the other firm, and the other party provided a settlement agreement.

After the settlement, there was still no sign of the transfer at the end of October. I contacted Amazon support again, and the response I got was that I needed to go to the other law firm to get in touch with Amazon's transfer department. I contacted our attorney to negotiate again, and that our attorney had direct access to Amazon's legal department, and after about 12 reminders, Amazon's legal staff surprisingly informed us that our case had been ruled a post-default settlement (after previously being told that our attorney was in the middle of the process).

It is now the end of December, our company is focused on selling holiday products, and we have accumulated more and more money at Christmas, but until now Amazon has not transferred the money to the other side, and we can not check the progress through any department of Amazon.

It's been more than three months since the settlement, does any of you know how to solve this problem quickly?

Using the word "quickly" alongside "Amazon" is a new oxymoron. NOTHING moves 'quickly' on Amazon (except perhaps, suspensions.)

Did you verify with AMAZON that they would agree to do this or did you (and your attorney) just figure it would be the fastest way to do something? Sort of like in the real world and NOT in Amazon Bizarro World.

There have been posts about Amazon seizing money in accounts and sending the funds to the plaintiffs as a result of a court ordered settlement but I don't recall seeing anything previously about Amazon sending money where it was a negotiated settlement payment.

I would guess the fastest way to accomplish what you want is to fund the settlement with other money, get it done with, and then get a release from the brand telling Amazon to pay YOU since the complaint has been settled.

By "post-default settlement" are they saying that it is too late to fix the problem and Amazon has seized your funds already? Hopefully your attorney has a grasp on what they mean. Mine is already in bed or I would ask her for any nuances there!

If you have opened any cases provide a number so any MOD that happens to drop by can look it over to see if they can help.

Without a case number in the posts it wastes time for everyone. I no longer tag anyone if there is no case #.

They have to ask for it and then wait for a reply from the poster and then the poster has to wait again for the MOD to find the case, and then more waiting.…

This will be like beating a dead horse, BUT before YOU decided to do that you should have asked a competent attorney (one that is VERY familiar with Amazon and the issues involved with funds being held) what you should do.

IF you had done that and they suggested this you could at least try to recover some funds through a malpractice liability policy.

Instead, you have created what is nearly the ultimate "Catch 22" situation.

The complaining party has refused to give you an LOA or a license to sell the products and AMAZON requires one or both of those to LEGALLY release your funds to the attorney for the settlement.

The other REAL problem is that even if you come up with the money to pay off the attorney, they have ALREADY told you they will not release you because the BRAND has already refused to provide you with what you need. They ARE the attorney for the brand, aren't they?

There seems to be virtually nothing that you can do at this point to untangle the mess that you helped create.

Go back and read what @Seller_R6Pw3cjCRwLNP has told you. They are pretty spot on, BUT I personally feel paying the attorney out of pocket and HOPING that Amazon MIGHT choose to release any money is a LOT of risk. Certainly a risk that I would not be willing to take.

Go sell elsewhere but learn the rules of the new site BEFORE you jump in.

There have been posts about Amazon seizing money in accounts and sending the funds to the plaintiffs as a result of a court ordered settlement but I don't recall seeing anything previously about Amazon sending money where it was a negotiated settlement payment.

I would guess the fastest way to accomplish what you want is to fund the settlement with other money, get it done with, and then get a release from the brand telling Amazon to pay YOU since the complaint has been settled.

This will be like beating a dead horse, BUT before YOU decided to do that you should have asked a competent attorney (one that is VERY familiar with Amazon and the issues involved with funds being held) what you should do.

IF you had done that and they suggested this you could at least try to recover some funds through a malpractice liability policy.

Instead, you have created what is nearly the ultimate "Catch 22" situation.

The complaining party has refused to give you an LOA or a license to sell the products and AMAZON requires one or both of those to LEGALLY release your funds to the attorney for the settlement.

The other REAL problem is that even if you come up with the money to pay off the attorney, they have ALREADY told you they will not release you because the BRAND has already refused to provide you with what you need. They ARE the attorney for the brand, aren't they?

There seems to be virtually nothing that you can do at this point to untangle the mess that you helped create.

Go back and read what @Seller_R6Pw3cjCRwLNP has told you. They are pretty spot on, BUT I personally feel paying the attorney out of pocket and HOPING that Amazon MIGHT choose to release any money is a LOT of risk. Certainly a risk that I would not be willing to take.

Go sell elsewhere but learn the rules of the new site BEFORE you jump in.
