Not VAT registered as under UK VAT threshold

Hi,

I have just set up my new business, designing scale model kits and my first product is ready to sell. I have completed the Amazon registration but I cannot continue because it insists I pup in my VAT number, but I do not have one, my accountant tells me that I am not legally required to be VAT registered until I reach the £70k per year limit.

What can I do?

Are you an UK seller with an UK business address or is your business registered using a virtual office address?

If this is the case, then you will need to register for the VAT.

Yes, I am based in the UK and already have my own website. The business is registered as a limited company at Companies House and have had this business since 2001. I used to design products for other manufacturers in Italy but last year decided to design, produce and sell my own products.

I don’t mean to be rude, I realise you are saying that you are UK based and established at a real address, not virtual, however the VAT threshold you are quoting (£70,000) is the EU distance selling threshold, not the UK registration threshold (£85,000)

Have you entered any registration details for the account contact, beneficial owners or anything as being overseas? Are any beneficial owners or officers overseas nationals?

You are right, it is £85k. I assumed it was £70k for some reason but, because I have never been VAT registered and my earnings are well below this, I never took much notice with the current threshold rate. I am most definitely UK based, Forest of Dean…

I was born in Redditch in the Midlands, so no, I am not an Italian national, nor do I have any kind of duel citizenship

I spent three years in Italy, working, but came back to the UK in 2010, 9 years ago. This is perhaps where I got the £70k threshold from.

It all started when they emailed me to say

“ We have reviewed your account and as per our records you are required to be tax registered in Germany. Please note that sellers legally-established in a country of the European Union, Iceland, Lichtenstein or Norway who do not provide a Tax Certificate by October 1, 2019 will no longer be able to sell on Amazon.de or to customers in Germany.”

It feels like Amazon is now deciding who should register for VAT and not HMRC.

I shall see what they say but I’m clear in my mind that Amazon is in the wrong here.
