Product is not a health product but a spoon yet was restricted for being a health supplement/medical device

We sell this small measuring spoon used to measure a paste or resin. This spoon is a serving spoon essentially for our products.

Interestingly, it was flagged as a health product that requires a Natural Product Number. We reviewed the Health Canada requirements, and our product clearly does not fall under health supplements requiring an NPN or DIN. To put it simply, see below what qualifies for DIN/NPN.

Reviewing Health Canada requirements. The NPN specifically applies to health products or homeopathic remedies as described below.

This Licensed Natural Health Products Database is managed by Health Canada and includes information on licensed natural health products, including:

  • vitamin and mineral supplements
  • herb and plant-based remedies
  • traditional medicines like Traditional Chinese Medicines or Ayurvedic (Indian) Medicines
  • omega-3 and essential fatty acids
  • probiotics
  • homeopathic medicines
  • many everyday consumer products, like certain toothpastes, antiperspirants, shampoos, face products, and mouthwashes

Our product does not fall under any of the items above and therefore is not covered by NPN requirements.

The product likewise does not fall under Medical Devices as defined below.

The term Medical Devices, as defined in the Food and Drugs Act, covers a wide range of health or medical instruments used in the treatment, mitigation, diagnosis, or prevention of a disease or abnormal physical condition.

We submitted all the necessary explanations and were initially told that Amazon only works on appeals with recent sales. They then closed the case right after without further information. See the response below:

"Thank you for submitting an appeal.

We are currently reviewing appeal requests for active offers with recent sales. We will now close this case.

You are welcome to reopen the case if you would still like to continue listing this ASIN.

Regards,

Deepak"

We responded right after asking for clarification, and then did a follow-up since they did not respond. Amazon's compliance team now responds with a copy-and-pasted response, informing us that our product is a health product and we need to upload proper labels and images and refrain from making health claims.

This is just a metal measuring spoon.

If anyone in the community can help or if we missed something, we greatly appreciate it! Case ID: 15445273601.

Thank you!

Hello @Seller_unvDAQ1xP5Sq5,

Mod here jumping in to further assist, thank you for the case ID: 15445273601.

I will be taking ownership of the follow up response, 11 days seem an outrageous time to resolve an ASIN appeal.

I can't escalate the situation until the catalog team resolves the case with a proper resolution.

Will pay close attention to their case handling, would suggest you to reply back with the requested changes.

I will be in touch.

Daryl
