Trademark on the word "pickleball"???

Hello! For some reason for only some of our listings, not all, we are getting flagged saying that "pickleball" - which is the name of a sport lol - like basketball, baseball, hockey, tennis - anyway, that we are infringing on a trademark. I spoke with one rep at amazon the first time, and they got it fixed for me, said, yeah, you're right, that should not have happened. Then...we get flagged again, I speak with someone else, they say they have to speak the appropriate team and get back with me, and then get back with me and say YES...you are infringing. So I can't seem to get this universally addressed and fixed. Any one have any good feedback from us? There are literally probably hundreds of other companies obviously using this word if you look up any kind of "pickleball" products on amazon...

Reg. No. 999043 is for the Trademark "Pickle-Ball", and is owned by OLLA LLC., and applies to Class 28 goods (basically, any of the equipment you need to play the game).

Thank you for your post. I understand you are dealing with a TM violation. Due the varying appeal paths depending on the violation, can you clarify exactly what category of violation you are trying to address? You would want to look under either "Received" or "Suspected" Intellectual Property (IP) complaints.

If you are seeing a "Suspected" IP complaint, you will need to be edited to remove the infringing content. From the violation itself, you will want to click on the "Edit" button on the right hand side of the violation. This will redirect you to the inventory page. From there, you can make the required edits. It is important to get the redirect from the violation page to the inventory page as this is how the system will know you are specifically making changes to address the violation.

In your particular case, you will likely need to make some kind of change to the pickleball specific wording of the product to reflect that you are not infringing on the "pickle-ball" brand specific trademarks

If you are seeing the complaint in the "Received", you will likely need to provide authorization documents such as valid invoices or a letter of authorization. Please note that any submitted documents would need to adhere to our invoice requirements.
