intellectual property infringement

Hello everyone,

I am currently selling auto parts that come from a manufacturer that supplies OEM parts. We listed our products under another seller's listing, but it turns out they have brand registration for those products. Although they are sourcing from the same manufacturer as we are, they filed a counterfeit complaint against us.( manufacture confirm this info )

I have provided invoices and photos to show that we are selling the exact same items, but I continue to receive the same response. Is there any specific process I should follow to reinstate my account?

These is the info from email

Please provide one of the following:

-- Proof of product authenticity (e.g., invoice, Order ID, or letter of authorization). It must clearly prove that your products do not infringe on the intellectual property of the rights owner.

An appeal with the following:

-- Greater detail on the actions you have taken to resolve the complaint.

-- Greater detail on evidence or examples that demonstrate your account has complied with our policy.

So your invoices are for the exact same brand? Your packaging looks exactly like their branded packaging? You product, as a whole, looks identical to theirs, packaging and all? Because otherwise it is NOT THE SAME

And even if it were, you need to be brand authorized for anything to list on Amazon.

Thank you for the information provided regarding the issues you have been seeing. I understand that you have received complaints regarding the products being infringed upon. With this, our team will be looking to see that you are authorized by the brand to sell the products. If the brand has not provided that authorization, we cannot guarantee that you can properly dispute the concern.

Based off the messaging, it would seem our team may be willing to accept a plan of action. A plan of action is giving our team more details regarding the violation that occurred, how you are correcting it, and what steps you will take to ensure it doesn't happen again.

For this situation, your plan of action should include not listing these products without the authorization from the brand. The steps that you put in place should be able to provide an understanding on how you will ensure intellectual property will not be a concern.

We encourage you to continue to provide any details you have on this situation to this thread for support.

Best,

Atlas
