Report Abuse for Trademark Abuse

Dear Sellers and Amazonians,

We are seeing more of an abusive selling practice on Amazon whereby sellers use trademarks to appropriate listings from other sellers.

Some businesses are focussed solely on exploiting this strategy, and it can lead to a situation whereby a micro business can own in the region of 100 trademarks with the IPO (one hundred!).

I am reluctant to give full details here, in case it encourages more of this behaviour, but perhaps some other sellers will have come across the problem as well.

We have notified Amazon using the Report Abuse form so far without any luck. We see this as a clear violation of the Seller Code of Conduct, but we are met with the response that "Thank you for your report of a suspected policy violation. We cannot take action on the report as no violation has been identified on the reported [ASIN removed] for the violation type selected."

We received this response almost instantaneously, and we worry that the time hasn't been taken to review our report sufficiently. At the very least we would expect to receive a reason why this is not viewed as a policy violation.

So many people seem to be doing this. There can literally be 50 listings for the same product where people are using their trademark to use as the brand and then not allowing anyone else to sell the product. Even if its not their actual product and they are definitely not the brand owner

Is this like when sellers list advent calendars but under a luxury brand of Christmas Cards who happen to produce some of the most obscure and unique designs imaginable.

Various ways they do it.

- List a branded advent calendar in a bundle of 2 or more - its then not the product in question, so they canuse their own brand

- Same as above - but bundle in a cheap set of chocolate coins or balls or something - again, can then claim its not the original product

- Just list the original branded product under a new barcode that was purchased from GS1 - again, amazon won't see it as the original product

With minor brands they manage to change the brand name to theirs using the original EAN number which means no one else can sell them.

I do some bundles with the written permission of the manufacturer, but it's for products that are too expensive on their own due to postage but if bundled in two or three become a good deal. I don't claim them as mine though.
