Suspected intellectual property infringements

suspected intellectual property infringements.

new heading on seller central - account health.

(has been on france for about 2 weeks and spain/italy for 2 - 3 days.)

and has today appeared on amazon uk seller central accounts.

seems to be bot driven as commonsense has not prevailed.

as for us it has labelled Nintendo games that are suspected of infringing Nintendo’s trademark ?
(these are all genuine original games for Nintendo consoles and in each case are manufactured by Nintendo)

and XBOX games suspected of infringing XBOX trademark
(again these are again all genuine original games manufactured or licensed by Microsoft (XBOX))

These Suspected Infringements are becoming more common… Out of interest do they have a negative impact on your seller account, or is it simply a case of if you want to sell the product under suspicion you have to either edit it or contact Amazon to get that product re-listed?

I have had 10 added to mine for the words Nintendo and angry birds, all soft toy items and they have removed all items now from their catalogue, the angry birds are angry birds and same as the Mario toys, tried editing as they suggest but no joy there either.

I did get a message back suggesting to edit the titles of the games and put
“compatible with” into the title.

I messaged back and said yes - if I was selling a charger or accessory that was not authorised by the manufacturer but was compatible then yes. but not for a game manufactured by the company concerned.

can you send them a photo of the hang tag that says the barcode and licensed by Nintendo / Rovio etc.

Issues started for us in 2014 with IP and has got worse every year on the Amazon platform. These big brand companies such as warner bros & disney handing out licenses over the years to distributors and eventually wholesalers whom we buy from. Last year we started seeing some wholesalers get greedy and gain sales by direct selling through Amazon. Initially it was under the radar with denial when we queried it but now its a blatant practice. In some instances we have been withdrawn from selling on certain ASINs whilst trying to win the buy box to get rid of small amounts of branded stock that has been holding up space in our warehouse and others ASIN’s we can not compete on price unless we make a loss.

I sort of get that Amazon is focusing on counterfeit etc but personally this has been taken advantage of by the brand license holders by being in a position to eliminate the competition and gain from direct sales through Amazon.

Hi

I think there is some confusion here, I noticed if you use the words For or Compatible With it is acceptable to use a trademark name? It appears by just adding the words can make the world of difference.

For example compatible with Parker Pen XYFS, For Iphone 8 plus or screen protector for Samsung etc etc

Also a polite note I was looking for some boxing gloves and checked the descriptions of them beware of using the word “Velcro” quite a few sellers have been pulled up for this. Change to description to Hook & Loop unless of course if you are using genuine Velcro.

Also another thing is Patents… will not go into that.

I enquired about this with amazon

We deleted all the items and once deleted they will disappear on the next review.

Alternatively change title so it does not reflect a brand in the title and not relation to any other trademark.

Then if accepted it will go after your never review.

This does not effect your account but if it goes to an actual infringement then it will be used for account.

So best to deal with it as soon as it comes

Hi all … been reading this thread… Don’t know if it will help but I list my compatible swatch straps with the following disclaimer with all my listings:

"SWATCH® is a registered trademark owned by SWATCH AG (SWATCH SA) (SWATCH LTD). Please note that this product has not been approved or sanctioned by the trademark owner."

You can always just add the first sentence on your listings to reflect that the brand “Nintendo” belongs to them.

Dunno … might help.
