Other sellers are selling on my listing under my brand, using mycontent, they sell their products.

Dear Amazon Help,

Can someone please explain why other sellers can take my buy box on my listing and sell their products under y listing? We have been using our brand YBBY since 20 February 2024. There are a lot of photos and videos of our brand products with our models and pets. And we do not allow anybody else to use them. During this time we have sold 2109 products units on Amazon.com under our brand. Moreover, our brand started its registration at USPTO on 20 of November 2023.

Now we have received the information from USPTO that our brand YBBY was registered on 16 of August and now we are just waiting for 3-4 weeks for the system to update this information automatically. But 4-6 other sellers are now trying to sell their products under our brand - which we do not allow them to do. And we see negative reviews from customers about these sellers. But until the USPTO system will not update the status of our brand - we can not delete these illegal sellers from our product listing. But we do not want to wait 1 more month when the system of USPTO will update the status. Because we are loosing money each and every day, may i please ask you to prohibit any other sellers to sell under our YBBY brand. The only brand owner is 22&Co LLC. Please delete all the sellers from our brand listings - they are trying to sell their products under our brand. at our listing!!!

Thank you for posting on forums! My name is Sandy from the Community Manager team.

Amazon's policies allow any seller to list items for sale on an ASIN so long as the intellectual property accurately represents the item being sold and has not been illegally reproduced. This includes intellectual property for which you are the rights owner.

Have you completed a test buy through these sellers? If they are selling your branded product that is illegally reproduced, you can submit these through the Report Abuse tool or Report a Violation tool in Brand Registry.

If you have any case IDs for your situation, I can take a look into the ASIN details and provide the best approach! Please let me know.

As @Sandy_Amazon notes, all ASINs belong to AMAZON and not the seller.

You don't say if you are in Brand Registry or not. Without that you will be forced to do test buys as she noted.

In addition, get into BR and then you can try this. Actually, you can try it before, but it works better if you are in there.

WHITELISTING

It seems clear that Amazon is only allowing MAJOR brands to 'whitelist' which sellers are authorized.

It was suggested by one of the long term experienced sellers on a different forum that the following has worked successfully in the past.

Have your attorney send a carefully worded Demand Letter (by Certified Mail) to Amazon’s "Office of the General Counsel".

I would think that you would want to include appropriate paperwork showing ownership of the TM from the USPTO, proof of registration in Brand Registry, and, any links to cases and messages that show that SO FAR Amazon has refused to protect your brand.

Basically, you need to put Amazon on notice that you expect the protections promised by Brand Registry.
