AMAZON DESTROYED MY INVENTORY UNJUSTLY

I first got a counterfeit product complaint and my listing got deactivated i submitted the invoice to my wholesaler it got activated for a week. then it again got deactivated after that I tried many times but it was not restored and I got email from Amazon that you have 30 days to submit documents to prove that you was not seeling counterfeit products. I tried to contact the brand itself and they said we didn't said amazon that counterfeit products are sold we just don't want anyone to sell our inventory on Amazon so you can remove it and sell it somewhere else or return it to your supplier. I also asked my supplier for the supply chain documents which I got from them all verifiable going back to brand. I communicated with Amazon submit all the documents and my communication with the brand but I got email that we are destroying your inventory as unsuitable products. Please help me how can I claim my right it has effected my mental health because of being so helpless even after trying so much and having all the legal documents you are treated unfairly because of no power. These are total 863 units worth around 8000 $ and this is a huge amount for me.

If the brand says you can't sell on amazon and you tried to anyway then those are counterfeit products. Amazon can neither return the items or the money by law.

You first posted about this 6 months ago. You were told by @Seller_4zBzdtgCyS9EIat that time that you needed an LOA from the brand authorizing you to sell on Amazon.

Then you said the brand allowed you to sell in the US IGNORING the part about being allowed to sell on Amazon.

Now you clarify that you can't sell on Amazon:

"I tried to contact the brand itself and they said we didn't said amazon that counterfeit products are sold we just don't want anyone to sell our inventory on Amazon so you can remove it and sell it somewhere else or return it to your supplier."

You need to proof authorization to have sold the product on Amazon.

@Maq_Mish if you have that and share a case number I'll check into it to see if there are additional details but can say with near certainty that that authorization will be required. "

You do NOT have any authorization and the brand does NOT have control over Amazon confiscating your products.

" we are destroying your inventory as unsuitable products. "

Unsuitable products are determined by AMAZON and this comes about largely as a result of the INFORM Act.

The anti-counterfeit policy can be found here:

https://sellercentral.amazon.com/help/hub/reference/G201165970

UNSUITABLE INVENTORY POLICY

https://sellercentral.amazon.com/help/hub/reference/GH4YYXNDRW9BSZEN

(Emphasis added to important parts)

Unsuitable inventory investigations policy

Customer trust is paramount to Amazon, and we strictly prohibit the sale of counterfeit products and other illegal goods. If we find that you have engaged in the sale of such goods through our fulfillment network, we may deactivate your account and offers, consistent with section F-7 of the Fulfillment by Amazon Service Terms in the Business Solutions Agreement ("FBA Service Terms"). We may also withhold and/or dispose of your inventory in order to protect our customers and sellers.

Amazon will notify you if we require additional information about inventory that we have determined may constitute Unsuitable Units under the FBA Service Terms. If your inventory is withheld due to suspected violations of our anti-counterfeit and restricted products policies, we will notify you by email and conduct an investigation.

As part of this investigation, we may request that you provide additional information or documentation regarding your identity, product authenticity, and compliance with applicable laws. We may validate any information that you provide with third parties or government agencies. We may withhold some or all of your inventory while we investigate.

If you do not provide the information we request by the stated deadlines, or if we find that any of your inventory constitutes Unsuitable Units, including but not limited to as a result of fraudulent or illegal activity such as the sale of counterfeit products or illegal goods, the violation of Amazon’s anti-counterfeit policy, or submitting forged documents to Amazon, we may dispose of any such inventory immediately, in accordance with the FBA Service Terms. If we determine that your inventory has not violated this policy, we may release the hold on your inventory or allow you to request that it be returned to you. "

Be sure to send a nice note thanking all the YouTube and TikTok producers that got you into this mess.

Did you get something in writing from the brand, on brand letetrhead and signed, with contact info for the person that signed it, all in one paper. Stating that you purchased the items from one of their authorized distributors and authorizing you to have your inventory returned to you and sell at another marketplace?

Based off of the information you have provided, I see that you have received a counterfeit complaint and your listing was deactivated and your products have been destroyed and not returned to you.

Per our amazon product authenticity and quality policy, all seller's must comply with our policies and guidelines. Based on the severity of a policy violation, amazon may:

  • Remove your listing
  • Limit, suspend, or block your ability to list and sell
  • Remove or dispose of your FBA inventory
  • Withhold payments

What could have contributed to the complaint? Where are you sourcing your products from? Are you sourcing from a reliable supplier?

Per our best practices in product authenticity and quality help page, all sellers must comply with federal, state and local laws and amazon policies. All sellers must list and provide authentic product on amazon and to the customers.

How do you make sure that your supplier is providing you with authentic products?

I would like to thank @Seller_0rXAME9V4LQSx, @Seller_kIukTwdhvntAp, and @Seller_4zBzdtgCyS9EI for your guidance and assistance.

If you have additional questions or concerns, please let us know here in this thread.

Sue them. Items that are the actual brand may be an IP violation but NOT counterfeit. And calling them counterfeit is slander/libel.
