Has anyone took amazon to court?i

Has anyone took amazon to court and can recommend a good lawyer?

I have been selling on amazon for a few years.

Recently a few months ago we had a seller start to list products under our brand which is registered in the uk.

So we reported them and after many weeks finally got them off our listings.

We have started legal action against this seller due to the damages our company has accured since the seller was selling fake products under our brand and we are now waiting a date for the hearing.

The seller did not like this and now this seller has started to place fake orders and leave is bad feedback and opened a-z cases. We have reported this to amzon but noting os being done from amazon side and every time we open a case it gets closed and the issue is not resolved. This seller even called us on the phone and said he will destroy our business and it seems he has done this.

So far this perosn has placed 6 orders and left negtive feedback on the orders.

We have sufficent evidance to prove that this buyer is the same seller we had removed from our listing.

We now have £0 in sales due to such high bad feedback ( in february before this seller started all this we had £5000+ sales for thr month)

We have no choice today but to stop selling on amazon now due to this.

Can anyone advise how we can take legal action against amazon as now oir bussines has been destroyed due to amazon not even bothering to help us with this fake seller.

Why Amazon?
Simply add the new material to your existing case and sue the seller concerned as he is the one causing you the damages.

You would have difficulty proving that the loss of sales was entirely or even partly due to the feedback

If the feedback is untrue and can be proven to have caused, or is likely to cause, serious harm in the form of serious financial loss, then you can sue the other seller (not Amazon) for libel or slander.
Amazon cannot be held legally responsible for this person’s actions.
Plus do you REALLY want to go up against Amazon’s army of lawyers?

You can try find a solicitor to take this on but I’m afraid that your case is very weak for 2 reasons:

  1. The post hoc fallacy
  2. Bad feedback on your account, whether deserved or not, goes back much further than a week
    I think you’d have a very hard time taking Amazon to court, the only winner would be your solicitor.

Have you tried pointing out how much they are losing in commission now your sales have dried up? Try the jeff@amazon.com team?

I know this doesn’t help with your situation and I’m sorry for what has happened, but I think generally in business, if you can avoid litigation, you should do that. Taking on a giant like Amazon isn’t really a wise strategy because they could stand the associated costs forever, so tactically you are immediately disadvantaged. Also, if it goes the distance, civil courts like to see that every effort has been made to avoid a court case. A shot across the bow might be a reasonable tactic for now, but you do need to make sure that you get the very best legal advice. Good Luck and I hope that your business comes back.

Get your listings on to Ebay and any other platform your products can be sold on, don’t rely on one stream.
Also have you thought about setting up a new business account and then selling on your old listings?
A laywer will end up costing alot more than the £5k you’ve lost in sales, use your time to build up sales else where. The person will get bored and go away.
If you have IP then you can put an infringement again their fakes.
