Has anyone successfully taken a courier to court for losing a parcel booked via Amazon Buy Shipping?

Hermes recently lost a customer’s order, value over £400. It was the first time I had used Amazon’s Buy Shipping. Following Hermes’ investigation they concluded it was ‘unaccounted for’. Value over £400, Hermes offered me compensation of £20 plus the cost of the label. Obviously this is not acceptable to me, as far as I’m concerned they have a duty of care and are liable for the full value. The Amazon Buy Shipping process never offered me enhanced compensation and never advised that the goods my not be safely delivered.
Has anyone taken a courier to court for similarly allowing goods in their possession to be misappropriated?

I doubt you will win - you are not Hermes customer and the contract was not with you, both Hermes and you had a contract with Amazon.
Also it was up to you to ensure that the service being supplied was adequate for the item you were sending. Sending a £400 parcel through a standard method without enhanced compensation was not a smart move.
And no courier can guarantee that they will successfully deliver your items, because they can not tell the future.
Sorry to say but if the service offered to you by Amazon was inadequate then you should have looked elsewhere for an adequate service, and I’m damn sure it says somewhere in the small print of the terms and conditions that you probably didn’t read what the service provided covers.
You’re lucky they offered you anything.

(how did you get a far as Hermes offering you £20
most of us have been told by Hermes that only amazon can claim as it was on their account.)

Thank you for the replies. What is done is done, I’m more interested in knowing if anyone has taken
actually taken a courier to court and won? Or, if they settled before the court date?
If there is a precedent I would like to be able to quote it in court.

The-Little_shop, At the time of booking the courier I was not informed of the insurance cover, £20 or otherwise. This was the first and last time I used Amazon’s Buy Shipping.
Here is the relevant paragraph from Amazon’s reply to me asking them to make the claim against Hermes on my behalf, or cover the cost of the missing item due to not being offered adequate compensation when buying the shipping:
“If an order is lost in transit or shipped to the wrong address, sometimes you can get help from your shipping carrier. If you purchased package tracking or insurance, the carrier might be able to help find the package or file an insurance claim. If you did not get tracking information, your carrier might have other options available to help find the package.”
So Amazon are saying I must pursue the claim with Hermes directly, which I did. And have been offered £20.
I would still love to hear from anyone who has taken a courier to court after they lost a parcel booked via Amazon’s buy shipping? Whether they won, lost or settled the case? Thanks

Amazon have advised me to pursue Hermes, and Hermes have offered some compensation. So the question over who is the account holder is moot. Hermes are happy to negotiate with me and not Amazon only.
I personally believe the question of insurance cover is irrelevant. Insurance is only offered for loss or damage. Neither is pertinent here. You can’t lose a 5KG 40cm box! It’s not an earing that may have fallen between the floorboards.
If you take your car to the garage for a service and they lose it, or allow it to be stolen whilst in their care, you would have every right to pursue them for compensation?
If I don’t get any replies from anyone who has taken a courier to court, successfully or not, I will do so and will update this thread accordingly. Watch this space.

Isn’t there a little box when you buy shipping that says something like “this does not meet your insurance requirements” or something similar? Today seems like an FBA day, but if i get an FBM order i’ll take a look.

Thanks everyone. I think we have exhausted the debate regarding whether compensation was adequately or obviously offered at the time. And whether the cover offered is pertinent in this case.
The courier has a duty of care regardless of the insurance.
I’m still really interested in hearing from anyone who has taken a courier to court? What was the outcome, what were the judges remarks?

JJCool. I’ll keep you posted. It’s £50 to go through the small claims court. Worth it I think to get this question answered one way or another. In any other industry the service provider will be liable for allowing your goods to be misappropriated whilst in their care.

In their industry it’s called Cargo Insurance I believe, and they should have it.
