Suspected Intellectual Property Violations
Hello,
I have gone to check my Suspected Intellectual Property Violations, and it appears i have 28 from the last week.
I stock ‘‘Funko’’ products from official distributors, and have sent invoices to amazon showing that they are the origonal products, but they keep insisting that i am missusing the trademark, it appears they think i am not selling origonal products ?
How can i sort this out ? Amazon is very stressfull these days, getting tired of it.

Unfortunately, it sounds like you are having the same issue as many other sellers.
There must be another trademarked term included in your listing’s title, bullet points or description which is causing this and you cannot really fix this as the other brands belong to the product name as well.
Such as “Funko POP Movie: Marvel Avengers 2 Hulk Bobble Head Vinyl Figure” - it obviously includes multiple secondary trademarked brand names.

Hi Rob,
Yes, they seem to be doing a HUGE cleanup of the listings. You will probably find that whoever created these listings put an incorrect Brand name, or a variation of the correct brand name, as the brand of the product. The brand name has to be an exact match to the protected brand. What I’ve done when this has happened is edited the listing and entered the CORRECT and EXACT brand of the product. However, make sure that it IS that brand. Because if you ask to change it to the official brand but it is not the official brand then you can get into trouble! If you get it from official distributors, then you should be safe being able to edit the listing in this way. I’ve managed to get quite a few of the listings I sell on reinstated by doing this.

My understanding of this is that unless you list against the official Brands ASIN for that specific product, Amazon will automaticallt mark any other listings as Suspected IP violation. They are trying to get rid of all the duplicate listings, and as typical of Amazon, they are using the biggest sledge hammer they can find to do the job.

I wish Amazon would be clear about this, Im not sure whether they suspect the listings are for ‘‘fake’’ products, or they are trying to get rid of duplicate listings like monkey boy said, if that is the case then i could simply re-list on the correct listing.
So, i should change the titles and descriptions to those supplied by the distributor, and then create a case letting amazon know ?
I feel like they will still ignore what im saying, as they are specificly telling me to remove the brand names.
Im just so confused, why do amazon have to be like this ?

You need to change the title to remove the word Funko. This needs to be added to the manufacturer.
Amazon say they will then be reinstated with 24 hours. I find this is never the case and I have to open several cases before I find someone from seller support who understands my very simple request.
You will get there in the end but, like everything on Amazon, it takes a long time and lots of interaction between head and wall.

I am having almost the same problem with them right now. I have spent the last month going back and forth with amazon and it has been incredibly painful to read their cut and paste responses. I have provided person after person with evidence from the brand themselves and they simply don’t read it. I took my case to notice-dispute@amazon.co.uk who will not even read the emails! they say they can’t find my account etc (funny how they find it for the fees and to send promo emails though)
It has taken another month to sort out for me and so I have asked for a refund as I cannot keep spending all this time emailing people who either can’t or won’t read them. They cannot even “understand” my email asking for a refund, they simply send the same cut and paste “so I understand from your email you have concerns about possible intellectual property violations…”
I don’t know if you have sent your case to the dispute team but maybe you will get more luck. But from my experience and from the emails they incorrectly sent me intended for someone called Pablo, I don’t hold out hope!
I want my last month and then I’m out of here. I don’t know if anyone else feels the same but do you feel it has gone like Ebay on amazon with only the high volume sellers getting any joy? Anyway I wish you all the best with your case. I have admitted defeat for my own sanity. It isn’t right what they have gotten away with but you can’t argue with stupid so I’m gone.

There is also another problem.
If you try to add a product that has been pulled it comes up with an error message.
So if the none of the previous sellers bother or are able to get it reinstated that product can never be sold on Amazon again.

@PURDY - the original Suspected IP Violation email from Amazon usually includes the one word which their bot is having trouble with.
For me this has been the spelling of the Brand name.
The main fields which require checking are the Title, Brand and Manufacturer. The Title needs the Brand included at the start and must be spelled the same as for the Brand field.
The Capitalisation of the word(s) must be the same as the Brand normaly use.
Post the original email from them and it may give other readers a clue.

on the Suspected Intellectual Property Violations list it will indicate which brand you have supposedly infringed, this brand needs to match the “brand” field on the product details exactly, if it doesn’t then the listing will be suppressed.
Even official brand-registered pages are being suppressed in this way if the title includes 2 brands in it (in the example mentioned here earlier, Funko and Marvel).
The only other time that you can get a Suspected IP Violation is when a brand logo is included in the product images and as with the titles the logo’s brand doesn’t match the brand on the listing.
There are other words available that work in the same way, I can’t seem to find the list though atm.
