Help Needed... Seller has listed against our brand registered product.

We also have trademark, the system of reporting violation failed. The listing contains our Trademark logo and our images and video of course are being utilized.

The first option is probably most applicable, but is greyed out: A product detail page is unlawfully using my trademark (for example, in product title, product images, product description).

If they're listing against your product, they're using the same Product Details Page as you, the one you set up, so even if you could report that you'd be reporting yourself as well.

I know some people have had trouble with reporting these types of violations due to some changes Amazon made a while back so I'm not sure what the best course of action is at the moment.

You could try the following steps to resolve this issue:

  • Contact Amazon Support Directly: Since the option for reporting the trademark violation is greyed out, reach out to Amazon Seller Support directly through a support ticket. Explain that the listing is unlawfully using your trademark, images, and video content, and that the standard reporting option is not available.

  • Utilize Amazon's Brand Registry Tools: If your trademark is registered with Amazon Brand Registry, you may have additional reporting options. Use the "Report a Violation" tool within Brand Registry to file a formal complaint.

  • Escalate the Issue: If you’ve already contacted support without resolution, escalate the issue by requesting to speak with a higher-level support representative. Provide evidence of your trademark registration, and clearly explain that the violation is impacting your brand.

  • Document Everything: Keep detailed records of all interactions with Amazon Support, as well as any evidence of the trademark violation. This documentation can be useful if you need to take further action or if you choose to involve legal counsel.

One of the products I sell has the same issue. I´m not the brand owner, but I´m a customer of the brand owner.

I have reported it. I got in touch with customer services. The brand owner got in touch with the seller (who is their customer). And nothing has happened. If I want to sell the product, I need to request permission from other guy who has registered it under a different brand.

I wonder what is the GS1 for, to be honest.

This happened to us while ago, the process that we were asked to follow was to do a test purchase from the other seller and then report it as "selling counterfeit product"

If you are the manufacturer and or importer of the product + brand owner this should not be a problem.

hope this will help

I had a similar issue a while back before I registered as a brand owner for a certain product.

Someone has basically hijacked that listing and is selling a generic, similar product.

As that product will be listed with an EAN barcode, and shows the brand, contact Amazon and give them the name of the seller and ASIN tell them the other seller is listing a product which is not a "Pazazz product" under that listing. Make it clear that the other seller is not selling the correct EAN product.

I have had success sending a polite but firm request to the offending company and giving them 7 days to remove their listing. Basically I confirmed that we were the brand owner (this product is branded) and have full rights on the pictures, content and the listing and we will report them to our brand manager after this period which could affect their account with Amazon. Usually another follow up at day 6 they respond and apologise and remove the listing. Quite a few sellers are just listing seperately everyones items and then drop shipping to the customer from yourself. It's annoying because the customer is not getting the best deal and customer care as you are not always dealing direct with the customer.
