GPSR and excluding NI as a Handmade seller in UK

I think I need to stop my items showing for sale in NI because of the new GPSR regs coming in. However I can't see a way to do this.

I sell on Handmade and don't have shipping profiles, my shipping charges are set by Amazon. I don't get to change them and I don't have a list of countries to tick/untick. Does this mean that I can't exclude NI? How can I be compliant for GPSR?

I take it from that you are on the individual selling plan.

If so that’s correct you can’t exclude Northern Ireland.

As such you are correct that you can’t 100% comply with GPSR as you can’t add the relevant data to the listings (manufacturers and responsible persons etc)

Unfortunately Amazon simply do not see that this is a requirement on Amazon UK.

Sorry there isn’t another answer.

Amazon are still saying that we can sell to NI safely even with GPSR. For the moment, I'm just going with the flow and seeing what happens.

Yep, too much uncertainty, even from reps offering their services. Best to let the dust settle.

This affects millions of sellers in the EU and around the world. If you do digi downloads, on Etsy you have to sell worldwide. So this affects all of them. And again, the reps can't decide what is and isn't covered when it comes to digital items. Yes, a plan to make a toy, probably. But a jpeg to print - who knows.

Then there's the Windsor Framework with changes/implementations in 2025 and on top, the UK parliament is (so I've heard) looking at harmonising our regs with the EU once again.

There's a lot there to track and I highly doubt the EU have anything of much in place to monitor this. They have been hinting they will release info to help small businesses before Dec 13, but they are cutting it close!

Shipping

We’re updating our shipping regions:

 Europe will become EU and Northern Ireland

 UK will exclude Northern Ireland

 UK will include Crown Dependencies (Jersey, Guernsey, Isle of Man)

 Rest of the World will exclude EU and Northern Ireland

Amazon need to do the same or allow sellers to have a global setting which states goods are sold to NI and not knowingly trans-shipped to EU (e.g. Republic of Ireland)

The below is irrelevant to the GPSR policy - though it does apply for the Windsor Framework rules coming in March 2025.

...or allow sellers to have a global setting which states goods are sold to NI and not knowingly trans-shipped to EU (e.g. Republic of Ireland)...

If you allow delivery to NI - simply put, you need the various GPSR requirements in place. As it stands, that is not achievable on Amazon.

Oh and there's also some uncertainty (with some experts) about what constitutes a 'new' item placed on the market. Depending on what you sell and when they were made, you could argue the items were pre-Dec13. How would the EU know what you have made and what you haven't, if you've been listing that product for months or years.
