VAT Establishment/Disbursements
I've received the dreaded Prove your EU establishment email, threatening to suspend disbursements.
I have a few Amazon accounts, but this is for an Estonian business (via e-residency), that is established in Estonia and the UK, however i don't have a physical presence in the EU. I've been 100% compliant. I've paid all VAT via VAT services/AVASK and am registered for OSS.
However am I right in thinking I'm going to receive a duplicate VAT bill from Amazon? Will they stop disbursements and will this affect disbursements for my other businesses.
Are they offering instalment plans? Am I going to have to request VAT refunds from all countries and will AVASK sort this?
Any help/advice appreciated.

Hi, Sadly no response from Amazon. The only things I have got, are a copy of the transactions and the generic email telling me to pay. They will have to wait, I can't pay until I get the VAT refunds, and with OSS it requires you to get refunds from each individual country.
Amazon couldn't care less. My existing funds are on hold and I've sold out of stock. I have no intention of selling again until the hold us lifted.

Hi! Just receivedthier response and basically I am stuck in the same situation as you now. The stock is still there, but I don't really want to send more, just giving them our money for free. The funny thing is that I was using the amazon VAT services, and they made this mistake still. So we are in the same boat now. Frankly speaking I was thinking about filing a law suit about this situation.

I would join you in a court case, but i haven't got the funds or time unfortunately.
VAT Services are now passing on fines for non payment of VAT, as i stopped paying VAT the moment they told me that they should be paying it. You couldn't make it up. A complete shambles.

hello. I am on the same boat. I have estonian company through eresidency as well. I dont know what is your recent situation but amazon took 24k euros from my account. took all the money from my amazon balance and my bank account. good luck

I am also concerned:
Estonian OÜ now being treated as non-EU established. We paid VAT to German tax office already. Amazon says they hold our cash to pay VAT and we must get the already paid VAT back from the German tax office. But they say Amazon is wrong and we must keep paying VAT to them.
I am happy with either way, but not to remit double VAT.
Anyone who has a solution to this case?

When I emailed finanzamt rostock(responsible tax office in germany for estonian companies) they said they heard that for the first time. we emailed back and forth and they said they wont pay me back. I emailed amazon and said this is what tax office said and amazon said "we will get back to you". Its been 1.5 month I am still waiting them.

Okay, the whole topic seems to be a new thing in Amazon and they are facing increasing difficulties upholding their line. The Finanzamt Rostock told us the same thing as they told you: That until now and also in the future, we will have to pay VAT directly to them, and that they will not reimburse us for any VAT collected from Amazon. Do you have an email address that has the authority to decide anything in this case?
