ASTM F963 Compliance

We sell toys, toy prams, strollers, dolls etc.

Amazon has rejected our compliance because they say we're selling strollers for kids (as in to put your kid into and push them around)

We sell toy strollers, to put your dolls into not your kids.

Anyhow we have provided the 3rd party tests, and these has been approved previously however the system can't get past the fact.

Can a community manager pelase help apply some sense to this case ID? 15840855601

Hi Glenn, the case ID was provided on the initial post on the forum - 15840855601 Amazon is still saying this is a carriage and stroller, when it is infact a toy. Does the ststem classify a toy car as a real car also?

I apologize for my lack of clarity. When I reviewed the Case 15840855601 previously, the most recent message indicated that the product did not require further documentation. However, there are other issues with the ASIN on your account that are preventing you from listing it. I would recommend checking your Performance Notifications and Account Health page to review and determine why your listings are currently inactive. Thank you for your understanding.

Hi @Glenn_AmazonI have checked the issue and I can see that it's blocked because of a copyright infrigement which is technically incorrect. Trademark misuse(KOOKAMUNGA) KOOKAMUNGA is indeed a brand on Amazon - a cat food brand - Howver our brand KOOKAMUNGA KIDS is also a registered brand on Amazon. We're registerd under the USPTO - so it seems like the system is picking up a missue when indeed it's not. How can we move forward with this and help to rectify it. The system says we must edit our listing to remove Trademark (KOOKAMUNGA) howeve our Brand name is KOOKAMUNGA KIDS we cannot remove our brand name

Hi @Glenn_Amazon Thank You, however I would expect that the team will come up with the same responses. Our trademark was registerd first at the USPTO - this is now business critical. If you could check up with the case and team, that would be great.

At this time I recommend you wait for the team to get back to you. If this case closes and the ASIN isn't reinstated I can see what escalation options I can offer but please note I cannot guarantee that the ASIN will be reinstated. Thank you.

Hi @Glenn_AmazonSelling Partner Support has not resolved this issue and has again directed us to remove our IP from the listing and PDP. The information is fairly basic, two Itellectual properties, different classes, similar names. In fact, if you wanted to get specific our USPTO trademark 'KOOKAMUNGA KIDS' was registerd and approved at the USPTO before 'KOOKAMUNGA'

Why can both IP not co-exist on Amazon?

If no guarantees can be made regarding the ASIN, then the system is simply broken, as we're not infringing upon anyone's IP and the escalation path should be quite simple.
