Intellectual Property Violation - Possible Hijacked Listing

Hi,

Need some help please - we’ve recently received a policy violation for Intellectual Property Complaint for ASIN: B06XC472NW, Infringement type: Counterfeit, Trademark asserted: UK00003827504.

My sent inventory was received on the 11th May and the complaint was raised on the 15th May with no orders for my inventory. I bought my products from an approved dealer and have an invoice confirming this. I submitted my POA along with supporting evidence but Amazon have replied with:

*Hello,
We received your submission but do not have enough information to reactivate your listing at this time. To reactivate your listing, please provide any one of the below documents for proving authenticity of your listings:
– A letter of authorization (LOA) or licensing agreement (LA) from the rights owner indicating that you are authorized to use their intellectual property. You can find the contact information of the rights owner in the listing deactivation communication you have received.
– An invoice to indicate that your products are original and are not duplicates or copies thereby infringing on the intellectual property.
– A retraction from the rights owner to be sent to Amazon directly. You can find the contact information of the rights owner in the listing deactivation communication you have received.

What happens if I do not send the requested information?
If we do not receive a response, the listing will remain deactivated. The violation record will remain on your Account Health page for up to 180 days after the listing was deactivated or until the violation is addressed. Deleting your listing on this ASIN does not sufficiently address the reason for the violation and will not result in its removal from your Account Health page. Leaving this and other listing violations unaddressed may result in account deactivation.

What I have noted is the brand owner is under another incorrect name of ‘HENSITA’ which appears to be recently amended and this matches a seller on the listing. They do not appear to be the brand owner or manufacturer when checking Stihl’s website and their own website is a very basic reseller type of various gardening equipment so they not appear to be linked to the manufacturer in any way.
This to me sounds like they have hijacked the listing and made themselves the brand owners. There were several other sellers on the listing who have now dropped off so it appears they have all been also reported. This appears to be clear abuse which I pointed out in my appeal however they did not even address this point. I have not been able to speak to an Account Specialist so far as they never call me when requesting a callback but I have raised a case and am awaiting on an update.

I obviously am not able to provide a LOA/LA due to the above and my invoice sent was from an approved Stihl dealer so I’m not sure what else Amazon want to confirm the products were authentic. I also did reach out to the so called brand owner in regards to a possible retraction but have received no reply.

My main concern is I do not want my account to be in jeopardy and would be willing to take a hit on the sent inventory even though it is 110% genuine but will deleting my offering be enough here to stop any account issues?

Does anyone have any advice on what to do in this situation please?

Sadly, this is a classic example of the mess of Amazon’s catalogue, a situation which they have facilitated themselves.

Was your offer listed using the EAN on the actual item? If so, maybe you can challenge the Hensita listing via Seller Support stating the it has been listed under the incorrect brand. But don’t hold your breath, it’s unlikely that Seller Support (or their relevant specialist team) will do anything about it.

If you listed it by product name match only and there is a more appropriate/correct ASIN for this item, then recall your stock and resend them under the correct listing. If there isn’t an existing listing, you may have to create one using the correct brand but Amazon may not allow you to do that. Amazon does seem to have preference for bad actors creating these dodgy listings only.

Looks like you should be listing on B004CYPW6C which is Correctly branded.

The other ASIN also has some dodgy looking reviews of other product s linked to other amazon sites.
