Seller Performance team keeps sending us this message:

Always worth checking with HMRC as appose to making any assumptions when it comes to matters of tax;

Below give a simple easy to follow guide CHAPTER 9 is applicable, Amazon appear to be on a purge of NETP / VAT Registration details, effectively VAT fraud method. This is due to the fact Amazon along with Ebay and other market places now digitally report out all sales and seller details to HMRC how can now validate the true VAT/TAX status of each seller.

9.1 NETP - definition

A non-established taxable person (NETP) is any person who is not normally resident in the UK, does not have a UK establishment and, in the case of a company, is not incorporated in the UK.

9.2 UK establishment: definition

A UK establishment exists if either:

the place where essential management decisions are made and the business’s central administration is carried out is in the UK

the business has a permanent physical presence with the human and technical resources to make or receive taxable supplies in the UK

We would normally consider a company which is incorporated in the UK to have an establishment in the UK as long as it’s able to receive business supplies at its registered office.

Exactly, we have a valid and Amazon verified UK VAT number! Even though we haven’t met the minimum required 85,000 GBP turnover in sales.
And VAT-number-appeal@amazon.com has sent us an email confirming that everything is OK with us, and they apologized for having our account suspended by Seller Performance Team!

Our company is incorporated in the UK.

Are we still NETP, if our owners are non UK Residents?

And again, we have a UK Amazon verified VAT number from February 2019.

Well the good news is your GB Vat number is showing on your Amazon seller profile page and is valid in VIES.
Which wasn’t the case 3/4 days ago when you first asked as I checked.
So do get back in touch with the Amazon Vat team as they were probably just waiting for it to show as valid in VIES.
Your account may still be deactivated for a while as they probably have a backlog of sellers in the same boat as you.
Who were drawn to their attention because of the London Business Address you use being the same as many other companies who share it also.

Is your VAT certificate in exactly the name you are using on amazon?

I had this because my business name is “Heather Needham Silver” and my VAT certificate was “Heather Needham”. So Amazon accepted it 5 years ago and then rejected it recently. I had to get the VAT office to add the word “silver” to my registration and the certificate for amazon, just another one of their ridiculous things to stress us and waste our time!

Amazon of course didn’t tell me the problem just kept telling me my VAT No was wrong which I knew it wasn’t, I’ve been using it since 1984.

We have filed a new case, sent yet another email confirming that our VAT is uploaded and verified, and now we are waiting again.

We received a note last week that we should sent an e-mail to eu-vat-support@amazon.co.uk.
We tried to sent an email there several times, but the email always returns as rejected.
