Hello i hope one of the amazon moderators can help me here
My account was shut down almost 3 months ago over 1 specific Asin which I designed and produced based on a public domain character, Alice in Wonderland. However this character has been trademarked by another company ( from public domain)
In my listing I only used alice in wonderland ( its also a generic dictionary term so i was following amazon's IP policy on descriptive use) along with my own brand name and not to cause confusion or lead consumers to believe we are selling goods from the trademark holder.
Despite following policy my listing was flagged down and my account was suspended. Multiple appeals and POA have not been working and Im told that the only way to reinstate my account is to get authorization from the Alice in Wonderland brand. I dont have this as I never used any assets from the trademark holder. This trademark holder actually trademarked a character form public domain which doesnt give them the right to prevent others form using it
I have sought legal advice from an IP lawyer who confirm that Im able to use Alice in wonderland in our product as its our own design and sold under our brand. But the account health team isnt able to assess the use of public domain. Can you help me get my case to the relevant team ?
