Brand registry for a trademark owned by my other LLC

Hello,

Is it possible to register a brand in the amazon brand registry that is owned by a different corporation than the one associated with my amazon account? In details, I have 2 LLC's but I am the single owner of both LLC. My amazon seller account is registered based on my first LLC but my brand trademark is under my second LLC. I want to get the brand registry benefit in my amazon account and want to sell my products. Can i directly proceed with brand registry in such condition or do I need to issue a letter of authorization from my second LLC to my first LLC.

You have two options based on the help pages:

1.) According to the "Manage Brand Registry application issues" section at https://sellercentral.amazon.com/help/hub/reference/GJPGY8BRDAQUQV4V, the brand's Rights Owner (your second LLC) must submit the Brand Registry application. Once approved, they can add your selling LLC's account as a Registered Agent.

2.) Alternatively, your selling LLC can apply using a Letter of Authorization. According to https://sellercentral.amazon.com/help/hub/reference/GUF78PCXAMHDY2A6, the LOA must include:

  • Company letterhead from your trademark-owning LLC
  • Licensor (your trademark-owning LLC)
  • Licensee (your selling LLC)
  • Grant (the intellectual property being licensed)
  • Geographic Scope
  • Term (duration)
  • Authorized signature/stamp from the licensor company

Even though you own both LLCs, Amazon treats them as separate entities, so proper documentation is required.

May I ask if you are listed as the trademark owner for both brands? If you are the trademark owner and account details match it should not be an issue as many seller registers multiple brands under one selling account.
