Food product recall a year after sold - refund issued...
Hi everyone,
At the middle of 2022 I sold a total of 40 units of a food product on Amazon UK. I couldn't get hold of more units so I stopped selling that product. Amazon suppressed the listing in Dec 2022. (The listing wasn't created by me).
2 days ago the same product was recalled in Germany and in Belgium due to safety issue. (supposedly also different parts of the EU).
Amazon decided to issue a refund of over £300 due to product safety, even though amazon return policy is 30 days.
Since then I've done my research and found that the batch I was selling had no issue, only the newest generation of the product is affected.
I tried to reach out to amazon multiple times, providing me with all the information, but they ended up claiming that as long as the listing is not reinstated, they cannot do anything.
Obviously the listing cannot be reinstated by me, as it was never mine to begin with, also it would be impossible to find the person who created the listing.
My question is:
What would you do in the same situation? Is there someone more senior person I can reach out to?

IF you have gone through seller support you could try managing.director@amazon.co.uk outlining your evidence as to why the product recall only applied to a specific batch, and not the batch that you sold. After that, you would need to do a letter before action to amazon.

Search for kinder egg issue last year. Happened before and they got the media involved so Amazon refunded all the sellers.

There was also an issue with Ferrero Kinder Eggs where there was a massive recall and unaffected batches were refunded by Amazon.
I'd suggest going direct to the manufacturer and get recompense.
