A competitor has copied my patented product and brand registry is not helping

My fully patented product has been 99% copied by a competitor

I have filed a violation with brand registry but only received an auto message with "The products you reported do not match your patent. "

I have escalated the case, and no surprise more automated responses that don't help

The brand registry team is notoriously a worthless department so I will need this case to be escalated as I would like this to be handled by Amazon instead of having to file expensive lawsuits/legal escalations

I took a look at your reports and there may not be enough information for the team to make a decision.

I recommend reading through our Reporting Infringement page and then resubmitting with more information that follows those bullet points!

First off- What country or countries is your product or innovation patented in? You typically have legal recourse ONLY in the countries your patent(s) was issued in.

Secondly- It is a design or utility patent? Utility patents have a lot more firepower via enforcement, depending on the claims. If it is just a design patent, then all the knockoff has to do is LOOK like your product and that's usually enough. Brand registry is going to get themselves in real trouble soon if they don't follow through.

Third- You may have to lawyer up, and don't forget that U.S. Customs CAN stop an infringing product right at the dock once the court decides.

that is a legal question Amazon will NOT decide. Contact an IP lawyer, go to court, send Amazon a court decision and Amazon will take this seller down.

It's not the task (nor withing their competence) of Amazon to decide about existing patents and IP infringements. That is the work of courts.

You mention Brand Registry, but you don't mention Patent Evaluation Express. Which is the arm of Amazon that you need to register with if you have not already done so. I have successfully as well as unsuccessfully booted infringing items, but Amazon is pretty soft. Depending on the value of your loss, you need to decide if it is worth hiring outside IP counsel. A Design patent isn't nearly as strong as a utility patent. doesn't take much of a design change to get around the design patent. Utility is function. Good Luck. It's all very painful to deal with. I've lost a LOT of money due to knock offs on Amazon.

I have still not received a satisfactory nor reasonable response from Amazon

The worthless brand registry team has responded with "we determined that the products that you reported are not substantially the same as your patented design"

I have attached a screenshot that is extremely extremely dumbed down that even a 5 year old child could understand the infringement

We need a response regarding this patent infringement. As noted our lawyer has pointed out that "Amazon.com" is a seller which he said since we already have notified Amazon, he has said "Amazon is willingly committing patent infringement at this point"

Amazon should follow the "Intellectual Property for Rights Owners" page information which is in the Amazon terms and conditions

Our lawyer has stated that this is a cut and dry 100% clear patent infringement case and we ask that Amazon remove the listing instead of us having to escalate/sue everyone involved in this blatant patent infringement

For your information we have saved all communication with Amazon showing Amazon's unwillingness and legal negligence to stop blatant patent infringement

Please, we ask of the mods here, please escalate this case because we will legally escalate with all involved parties within the next 48 hours

Overall this is extremely typical of Amazon defending Chinese patent infringers which is a huge problem at Amazon and is a well known fact by the public and media

Remove the sales of this listing within 48 hours this is the last time I try to ask for help

This is always a risk with China, ESPECIALLY if you are having it manufactured there. Those factories have a refined process to take your money to build your widget then sell the design to other companies. The chances are high if you're manufacturing that in China it's the SAME manufacturer making VEVOR's knockoff.
